HomeMy WebLinkAboutContract 57937-A1 AMENDMENT NO. 1 South Patrol Division Facility STATE OF TEXAS CITY SECRETARY CONTRACT NO. 57937-A1 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Core Construction Services of Texas, Inc. (Contractor) made and entered into City Secretary Contract No. 57937 (The Contract) which was authorized by the City Council by M&C 22-0348, the 10th day of May, 2022, for the Fort Worth Police Department's New South Patrol Division Facility; and WHEREAS, further amendment is necessary to replace section E-4 of the general conditions of the contract for further clarification. NOW THEREFORE, City and Contractor, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: Section E-4 of the general conditions of the contract is amended as follows: E-4 MINORITY BUSINESS ENTERPRISE (MBE) The City will consider the CMAR's performance on other City Projects regarding its Minority Business Enterprise (MBE) program in the evaluation of bids. Failure to comply with the City's MBE program, or to demonstrate a "good faith effort", shall result in a bid being considered non-responsive. Upon request, CMAR must provide the City with complete and accurate information regarding actual work performed by a MBE on the contract and proof of payment thereof. CMAR further agrees to permit an audit and/or examination of any books, records or files in its possession that will substantiate the actual work performed by an MBE. The misrepresentation of acts (other than a negligent misrepresentation) and/or the commission of fraud by the CMAR will be grounds for termination of the contract and/or initiating action under appropriate federal, state, or local laws or ordinances relating to false statement. Further any such misrepresentation (other than a negligent misrepresentation) and/or commission of fraud will result on the CMAR being determined to be irresponsible and barred from participating in City work for a period of time of not less than three years. CMAR shall provide copies of subcontracts or cosigned letters of intent with approved MBE subcontractors prior to execution of the contract.
