Home My WebLink AboutContract 42248-A2 CITY SECRUJA am.- CONTRACT NOS Z*1 AMENDMENT No., 2 To DESIGN PROCUREMENT AGREEMENT THE STATE of TEXAS § City Secretary COUNTY of TARRANT § Contrail: loo WHEREAS, Event Facilities Fort 'worth, Inc., ("Developer") and the City of Fort Worth, ("City'% entered into a 'Design Procurement Agreement CS No. 42248) (M&C C- 25071' July 26, 2011) for certain improvements to Farley Avenue including the realignment of Harley Avenue from Rip Johnson to Montgomery Street and related drainage improvements (the 1%Project"), a,nd WHEREAS, as the Project progressed, additional facilities and infrastructure improvements, were identified to expand the parking system, and provide additional water, sewer and streetsea e improvements related to the realignment of Harley Avenue ("Amendment 1' M& C-25664, JLi1ne 6, 2012); and WHEREAS, as a result of the Project, additional offsite drainage improvements were identified including facilities within the Botanic Gardens enhancing the proposed location for the future Children's Garden as well as traffic signal and pedestrian improvements at Farley Avenue and University Drive were identified' and which are to he constructed under a separate Infrastructure Construction Agreement; and WHEREAS, 'Developer will continue to engage the services of Freese & Nichols, Inc. "Engineer' to pirovide the design work called for by this Amendment; and WHEREAS, Developer and City have agreed to the costs of the additional design work pursuant to this Amendment (M&C C-26217, April 23, 2013), and WHEREAS, Staff has reviewed the scope, fee, costs and schedule for the design of the Amendment and find them to be fair and reasonable; and WHEREAS, City and Developer intend to enter into an Infrastructure Construction Agreement for Harley Phase ("Harley Phase 3 CA") (M&C G ,791 6, June 4, 2013) governing the Developer-awarded construction and reimbursement from the City for the construction costs related to the design work under this Amendment No. 2. NOW, THEREFORE, KNOW ALL BY THESE PRESENTS., For and in consideration of the covenants and conditions contained herein, the City and the Developer do hereby agree as follows: General Regui . The Amendment will generally consist of offsite drainage improvements within the Botanic Gardens enhancing the proposed location for the future Children's Garden as well as traffic signal and pedestrian improvements at Harley Avenue and University Drive as further described by the 9 pages attached as Attachment A hereto (said pages being the same as the exhibits for Harley Phase 3 ICA). B. Developer will amend, its Engineering Contract with Freese and Nichols, Inc. C. City agrees to reimburse Developer, upon approval, of finial plans, for all additional engineering drawings, studies, renderings, contract specifications, estimates, and other documents,, and Harley Avenue Phase; 3 construction oversight, (collectively the "Second Amendment 'Work Product`� necessary, to construct the offsite drainage improvements as well as traffic s,ignal and pedestrian improvements at Harley Avenue and University Drive required by this Agreement an amount not to exceed $,112,9150.00!. Upon payment to Developer, all designs, drawings, specifications., documents, and other Amendment Work Product,, whether in hard copy or in electronic form, shall become the property of the City. - D. (EFFW) is managing this improvement th�rough two separate Agreements. Infrastructure Construction Agreement Amendment No. 2 to City Secretary Contract No. 42521 provides for improvements associated with additional waterX sanitary se:wer, paving, landscaping and parking infrastructure in response to changes in the facilities expansion plan, of the WRIVIC. In addition, this Amendment includes the removal of storm drainage improvements in Trinity Park,since it was determined that these improvements could be deferred to a later date.
