FIRST AMENDMENT OF FORT WORTH
CITY SECRETARY CONTRACT NO. 57341
This FIRST AMENDMENT OF FORT WORTH CITY SECRETARY
CONTRACT NO. 57341 ("AMENDMENT") is made and entered into by and between the
City of Fort Worth, a home-rule municipal corporation of the State of Texas ("City"), acting
herein by and through Dana Burghdoff, its duly authorized Assistant City Manager, and DBT
Transportation, LLC ("Vendor"), acting herein by and through Nancy Thomsen, its duly
authorized Chief Operating Officer, each individually referred to as a "party" and collectively
referred to as the "parties".
WHEREAS, City and Vendor entered into City Secretary Contract ("CSC") No. 57341,
an agreement for Vendor to provide, install, train City employees, and provide technical support
on the initial set-up of the Air Traffic Communications equipment (collectively the "Services")
for the City on the communications tower at the Airport (the "Agreement");
WHEREAS, the Agreement was executed and effective on April 1, 2022;
WHEREAS, the Agreement currently states that the Agreement expires on September
30, 2022 since it was both parties understanding that any additional time was not necessary;
WHEREAS, due to unforeseen supply chain constraints and shipping delays, the Vendor
has been unable to acquire all of the relevant equipment throughout the Term to fulfill all of the
Services required under the Agreement; and
WHEREAS, now, both parties wish to amend the Agreement to change the Term of the
Agreement to expire on March 31, 2023, one year from the Effective Date, to allow for more
time for the relevant equipment to arrive and enable the Vendor to complete the Services under
the Agreement.

NOW THEREFORE, KNOWN ALL BY THESE PRESENT, City and Vendor, acting
herein by and through their duly authorized representatives, enter into this Amendment, which
amends the Agreement as follows:

The Agreement is hereby amended by deleting Section 2, `'Term." of the Agreement in its
entirety and replacing it with the following:
2. Term. This Agreement shall begin on the date signed by the
Assistant City Manager below ("Effective Date") and shall expire on March 31,
2023 or upon the completion of all Services as defined herein ("Expiration
Date"), unless terminated earlier in accordance with this Agreement ("Initial
Term").

Except as expressly modified in this Amendment, all other terms and conditions of the
Agreement shall remain in full force and effect.
