FIRST RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY
CONTRACT NO. 57241,A NON-EXCLUSIVE MOWING AND GROUNDS
MAINTENANCE SERVICES AGREEMENT FOR ALLEYWAY MAINTENANCE
BETWEEN THE CITY OF FORT WORTH AND LEON'S LANDSCAPE SERVICES,
LLC
This FIRST RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY
CONTRACT NUMBER 57241 ("First Renewal and First Amendment") is made and entered
into by and between the CITY OF FORT WORTH ("City"), a home-rule municipal
corporation of the State of Texas, acting by and through its duly authorized Assistant City
Manager, and LEON'S LANDSCAPE SERVICES, LLC ("Contractor"), a Texas limited
liability company, acting by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, City Secretary Contract Number 57241 ("Agreement");
WHEREAS, the Agreement provides for a primary term of one year, with four (4)
subsequent one-year renewal options;
WHEREAS, the primary term expires on September 30, 2022;
WHEREAS, the parties desire to exercise the first one-year renewal term, effective
beginning on October 1, 2022 and ending on September 30, 2023;
WHEREAS, Contractor requested a unit price increase of 5.0% for work that it performs
at certain locations throughout the City; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for one additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the first renewal
term, effective beginning on October 1, 2022 and ending on September 30, 2023 ("First Renewal
and First Amendment").
II.
All unit prices in Exhibit B of the Agreement, including any previous On-Call
amendments if applicable, pertaining to grounds maintenance are hereby amended to increase the
pricing by 5.0% for all locations set forth in ITB/RFP No. 21-0096.

Section 3, "Compensation", of the Agreement is revised to increase the aggregate amount of the
Agreement from$293,400.00 to $366,750.00 and is amended to read as follows:
3. Compensation.City will pay Vendor in accordance with the provisions of this Agreement,including
Exhibit`B,"which is attached hereto and incorporated herein for all purposes. Total compensation under
this Agreement will not exceed $366,750.00($366,750.00 for each renewal term,if exercised).Vendor
will not perform any additional services or bill for expenses incurred for City not specified by this
Agreement unless City requests and approves in writing the additional costs for such services. City will
not be liable for any additional expenses of Vendor not specified by this Agreement unless City first
approves such expenses in writing.
IV.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this First Renewal and First Amendment.
2. All terms of this First Renewal and First Amendment that are capitalized but not
defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this First Renewal
and First Amendment to be effective on October 1, 2022.
