Home My WebLink AboutContract 53876-A2 CSC No. 53876-A2 AMENDMENT NO. 2 OF FORT WORTH CITY SECRETARY CONTRACT NO. 53876 BETWEEN THE CITY OF FORT WORTH AND ABESCAPE GROUP LLC This AMENDMENT NO. 2 ("Amendment") to City Secretary Contract (CSC) No. 53876, as amended ("Agreement"), is made and entered into by and between the CITY OF FORT WORTH ("City"), a home rule municipal corporation organized under the laws of the State of Texas, acting by and through Dana Burghdoff, its duly authorized Assistant City Manager, and Abescape Group, LLC. ("Contractor"), acting by and through Abraham Herrera, its duly authorized Owner. RECITALS WHEREAS,the Agreement was initially entered into between the City and Contractor on the 1 st day of May,2020; WHEREAS, the Agreement provides for mowing and grounds maintenance services for Fort Worth Meacham International Airport("Meacham"), as described more particularly in the Agreement; WHEREAS, on September 20,2021,the parties agreed to amend the Agreement to(i) correct the Term of the Agreement to accurately reflect the parties' intent of a two-year initial term with two one-year renewal options; (ii) eliminate Zones 19, 20, and 22 from the Agreement(iii) and update pricing for Zones 5 and 39 due to the changes in square footage required to be mowed("First Amendment"); WHEREAS, due to new development at Meacham, a change in plans or specifications was necessary for one of the zones eliminated under the First Amendment to be revived and incorporated back into the Agreement with an entirely new footprint to accommodate the new space in need of mowing services; WHEREAS, the parties would therefore like to revive and incorporate Zone 19 back into the Agreement with a new footprint depicted within this Amendment and update the Sample Work Order to reflect the additional Zone 19; and WHEREAS,the addition of Zone 19 will not require an increase in the maximum contract amount permitted under the Agreement for services to be paid to the Contractor. NOW,THEREFORE,for good and valuable consideration,the receipt and adequacy of which are hereby acknowledged, Lessor and Lessee hereby agree as follows: Fort Worth Meacham International Airport Abescape Group,LLC OFFICIAL RECORD Amendment No.2 to CSC No.53876 Page I of 38 CITY SECRETARY FT. Attachment "G", "Mowing Zones" of the Agreement is hereby deleted in its entirety and replaced with the attached Exhibit "A" to this Amendment reflecting the new "Zone 19" to be incorporated back into the Agreement. 2. Attachment"L", "Sample Work Order" of the Agreement is deleted in its entirety and replaced with Exhibit"B"to this Amendment. 3. Except as expressly modified in this Amendment, all other terms and conditions of the Lease shall remain in full force and effect. 4. The statements set forth in the recitals above are true and correct and form the basis upon which Lessor and Lessee have entered into this Amendment. The Lease is a public document on file in Lessor's City Secretary's Office and is incorporated herein by reference for all purposes. 5. All other provisions and conditions of the Lease that are not expressly amended herein or directly in conflict with the provisions and conditions of this Amendment shall remain in full force and effect.
