SECOND AMENDMENT OF CITY SECRETARY CONTRACT NUMBER 57669,
A PURCHASE AGREEMENT BETWEEN THE CITY OF FORT WORTH AND
DALLAS BASKETBALL LTD
This SECOND AMENDMENT OF CITY SECRETARY CONTRACT NUMBER 57669
("Second Amendment")is made and entered into by and between the CITY OF FORT WORTH, ("Buyer"),
a Texas home rule municipal corporation, acting by and through its duly authorized Assistant City Manager,
and DALLAS BASKETBALL LTD, ("Seller"), a Texas limited partnership. Buyer and Seller are herein
referred to individually as a("Party") and collectively as the ("Parties").
WHEREAS, on January 9, 2022,the Parties entered into a Purchasing Agreement for the purchase of
youth jerseys and shorts from the Dallas Mavericks organization, as part of youth sports programming, the
same being City Secretary Contract("CSC")Number 57669 ("Agreement");
WHEREAS, on September 26, 2022, the Parties amended the Agreement to increase the total
compensation amount from $7,700.00 to $18,000.00 to purchase additional youth jerseys and shorts, as
described in Exhibit D-1, attached hereto and incorporated herein by reference;
WHEREAS, it is the collective desire of the Parties to amend the Agreement to increase the total
compensation amount to accommodate payment of the $18,000.00 invoice for the purchase of youth jerseys
and shorts; and
NOW,THEREFORE, for and in consideration of the mutual promises and covenants set forth herein,
the Parties agree to amend the Agreement as follows:
I.
Buyer and Seller hereby agree to amend the Agreement to increase the total compensation amount
from $18,000.00 to $25,700.00, for the purchase of the additional youth jerseys and shorts.
II.
1. All terms in this Second Amendment that are capitalized but not defined shall have the same
meanings assigned to them in the Agreement.
2. All terms and conditions of the Agreement that are not expressly amended pursuant to this
Second Amendment shall remain in full force and effect.
