TEMPORARY LICENSE AGREEMENT

§ KNOW ALL BY THESE PRESENTS
COUNTY OF TARRANT §
THAT the undersigned, hereinafter referred to as "Licensor", subject to the terms and
restrictions contained herein, does by these presents grant to the City of Fort Worth, Texas,
herein after referred to as "Licensee", a temporary license to access and enter upon a portion
of the property described as Tracts 3, 3D, 3E, 3F, 3171, and 3G in the James Daniel Survey,
Abstract 395 and also known as 4201 South Cravens Road, Fort Worth, Texas 76119 (Tarrant
Appraisal District Account No. 03844730) (referred to as the "Property") as depicted in
Exhibit "A" (attached hereto) for the limited purpose of performing only the activities
outlined below (referred to as "Project"):
• On-the-ground survey to include boundary, topographic, tree, and/or
bathometric survey;
• Environmental jurisdictional determination to identify the "waters of the
United States" as defined in Section 404 of the Clean Water Act;
• General site observations including inspection of the downstream drop
structure near the east end of the Property (access from Cravens Road through
the Property will be required by foot only with no vehicles being permitted);
Notwithstanding the foregoing scope of the license, Licensee shall be entitled to
undertake such actions only if directly related to the Project. Licensee also agrees that
Licensee shall obtain certified engineering plans prior to making any alterations, including the
installation of a culvert. Licensee shall also deliver to Licensor: (1) copies of all
measurements, data, surveys, and recordings; and (2) all surveys, drawings, and plans in
native file format, including AutoCAD and drawing file formats, generated from data or
observations obtained in connection with or related to this license agreement.
This license shall expire 30 days from the date this instrument is signed by Licensor.
This license allows only up to five persons to enter upon the Property subject to the
limitations set forth herein. Entry upon the Property shall be granted only: (1) when a
representative of the Licensor is present; (2) between the hours of 9:00 a.m. and 4:30 p.m. on
days other- than a weekend or a holiday; (3) when scheduled in advance, directly with
Licensor, upon no less than 120 hours' notice; (4) at times and on days agreed upon by
Licensor; and(5) when a representative of the City is present.
To the extent strictly necessary to create lines of sight required for the on-the-ground
survey, Licensee may perform minor tree limb trimming and bush clearing.

Licensee shall restore the Property to the same condition as it was in immediately
prior to Licensee first accessing and entering upon the Property, with the exception of tree
trimming or brush clearing as allowed herein.
Licensee represents and warrants that all notices, hearings, votes, approvals, and
consents have been satisfied for this license agreement to be binding upon and legally
enforceable against Licensee. Licensee agrees to the terms of this license agreement by
executing and delivering this license agreement; accessing or entering upon the Property; or
otherwise invoking or availing itself of any benefit of this license agreement.
