HomeMy WebLinkAboutContract 52517-A3 CSC No. 52517-A3 AMENDMENT No.3 TO CITY SECRETARY CONTRACT No. 52517 WHEREM, the City of Fort Worth (CITY) and CDM Smith Inc. , (ENGINEER) made and entered into City Secretary Contract No. 52517, (the CONTRACT) which was authorized by M&C C-29181 on the 25th day of June, 2019 in the amount of $192,600.00; and WHEREAS, the CONTRACT was subsequently revised by Amendment No.1 in the amount of $97,448.00 authorized administratively on May 29, 2020 and Amendment No.2 in the amount of $141,740.00 authorized by M&C 21-0540 on August 3, 2021; and WHEREAS, the CONTRACT involves engineering services for the following project: Westside Water Treatment Plant Plate Settler Expansion; WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $99,500.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $531,288.00. 3. Cc: Tony Sholola,FWWD Stacy Barna,CDM Smith CIO LETTER-Westside WTP Plate Settlers Project-Amendment No.3 Request Letter FINAL SCOPE OF SERVICES FOR WESTSIDE WATER TREATMENT PLANT PLATE SETTLER EXPANSION PROJECT 102052 AMENDMENT NO. 3 - EXTENDED CONSTRUCTION PHASE SERVICES (THROUGH NOVEMBER 29,2023) BACKGROUND CDM Smith contracted with the City of Fort Worth for the Westside Water Treatment Plant (WSWTP) Plate Settler Expansion Project. The initial scope of work included development of design for adding additional plate settlers to the three sedimentation basins and the WSWTP to expand their capacity from the existing 15 MGD capacity to 18 MGD.Amendment No.1 to the contract was executed to provide additional design for the addition of Filter No. 5 and coordination of changes related to the membrane addition. Amendment No. 1 included design services for the following items: • Replace the existing raw water transit time meter and flow control valve with magnetic flow meter for better accuracy, • Provide an additional membrane feed pump with variable frequency drive,and • Relocate the potable water sample point following the clearwell storage tank. Amendment No.1 was for design only and did not include any engineering services during construction related to shop drawing review and RFI responses associated with the work for Filter No.5,the raw water meter and control valve,the membrane feed pump,or the potable water sample pump. The original agreement and Amendment No.1 included four construction meetings and two site visits throughout the 13-month contractual construction period. No onsite inspection or observation was included via the original agreement and Amendment No.1 Amendment No.2 provided for an on-site resident project representative for 8 hours per week, supported as needed by senior technical staff,for the 56-week (13 month) contractual construction period currently scheduled to end effective November 29,2022 (based on construction start date of October 25,2021). Amendment No.2 also provided for added duration of project management through June 30,2021 -10 months beyond the originally planned construction completion date of August 2020. Lastly,Amendment No.2 also provided for an additional 10 shop drawing reviews and 4 RFI reviews. Neither the original Contract,Amendment No. 1,or Amendment No.2 included any construction phase services beyond the 13-month contractual construction period scheduled to end effective November 29,2022 or any project management services beyond June 30,2021. This proposal for Amendment No.3 requests authorization for additional scope of work and engineering fee for providing additional engineering services during construction through the currently-projected construction completion date of November 2023. CDM Smith will provide project management for the period from June 30,2021 through the projected construction Westside WTP Plate Settler Expansion Project(102052) 1 Scope of Work—Amendment No.3 9/26/2022 completion date of November 2023. CDM Smith will also continue to provide an on-site resident project representative (RPR)for 8-hours per week for an additional 48 weeks, supported as needed up to 40 hours by senior technical staff assistance. SCOPE OF WORK-BASE SERVICES The scope of work presented below describes the additional base services included in this Amendment No.3. Task 1 Project Management Additional Task 1A-Extended Construction Duration Project Management CDM Smith will provide additional engineering services related to the day-to-day management of the project from June 2022 through November 2023. • Project Management and Administration Support Services: Plan, organize, staff, direct, manage,coordinate,and report work tasks of project team including subconsultants. • Reporting and invoicing:Prepare and submit twelve (12) monthly invoices with required forms. Construction Meetings: Project manager to attend up to 12 additional monthly onsite Construction Progress Meeting from June 2022 through November 2023 to review the construction progress, submittal status, proposals, outstanding invoicing, proposed change orders (PCOs),RFIs,and other pertinent construction issues. Task 1A Work Products: a) Twelve (12) Project Summary Reports. b) Twelve (12) Invoices with typically required City of Fort Worth forms. c) Twelve (12) Construction Progress Meeting Minutes. Task 2 - Basis of Design Memorandum No changes in scope of work. Task 3 -TCEQ Coordination No changes in scope of work. Task 4- Final Design No changes in scope of work. Task 5 - Bidding Phase Services No changes in scope of work. Task 6- Construction Phase Services Additional Task 6.1A-Extended Construction Duration Construction Services Westside WTP Plate Settler Expansion Project(102052) 2 Scope of Work—Amendment No.3 9/26/2022 The ENGINEER shall provide the continued services of the on-site resident project representative (RPR) for limited observation for up to 8-hours per week for the period from November 30,2022 through November 29,2023. RPR duties will be same asunder Amendment No.2,including review the quality of work (as observable at point of time onsite), document field progress,respond to field questions from the Contractor,and coordinate with City Staff. An additional 40 hours of senior level engineering staff will eb provided to provide technical support to the RPF in responding to field questions from the Contractor. Limits of On-Site Representation Responsibility: The purpose of on-site representation during the project will be to enable the ENGINEER to carry out the duties and responsibilities assigned and undertaken by ENGINEER during the Construction Phase, and,in addition,by the exercise of ENGINEER's efforts as an experienced and qualified design professional,to provide the CITY with a greater degree of confidence that the completed work will conform to the Contract Documents and that the Contractor and its Subcontractors have implemented and maintained the integrity of the design concept of the completed Project as a functioning whole as indicated in the Contract Documents. ENGINEER shall not be assumed to have reviewed work undertaken and covered or buried when not on site. ENGINEER will not, during such visits or as a result of such observations of the Contractor's work in progress, supervise, direct,or have control over the Contractor or its Subcontractor's work,nor shall ENGINEER have authority over or responsibility for the means,methods,techniques,sequences,or procedures of construction selected or used by the Contractor,for security or safety on the site,for safety precautions and programs incident to the Contractor's or its Subcontractors work,not for any failure of the Contractor or its Subcontractors to comply with Laws and Regulations applicable to the Contractor furnishing and performing the work. The ENGINEER's Project Manager,RPR,and one senior technical process mechanical staff member will participate in one Substantial Completion Inspection to review and advise the Owner on contract work to be completed as observable. ENGINEER will compile and submit a punch list documenting the remaining work to the CITY and Contractor.
