FOURTH RENEWAL AND THIRD AMENDMENT OF CITY SECRETARY
CONTRACT NO. 52041,A NON-EXCLUSIVE MOWING AND GROUNDS
MAINTENANCE SERVICES AGREEMENT BETWEEN THE CITY OF FORT
WORTH AND LAWN PATROL SERVICE, INC.
This FOURTH RENEWAL AND THIRD AMENDMENT OF CITY SECRETARY
CONTRACT NUMBER 52041 ("Fourth Renewal and Third Amendment") is made and entered
into by and between the CITY OF FORT WORTH ("City"), a home-rule municipal
corporation of the State of Texas, acting by and through its duly authorized Assistant City
Manager, and LAWN PATROL SERVICE, INC. ("Contractor"), a Texas corporation, acting
by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract Number
52041 ("Agreement");
WHEREAS, the primary term of the Agreement expired on March 4, 2020 and includes
four(4) one-year renewal options;
WHEREAS, the City and Contractor exercised the First Renewal Option, which expired
on November 30, 2020 the same being CSC No. 52041-RI;
WHEREAS, the City and Contractor exercised the Second Renewal Option and First
Amendment, which expired on November 30, 2021 the same being CSC No. 52041-R2A1; the
Amendment to the Agreement added additional inventory;
WHEREAS, the City and Contractor exercised the Third Renewal Option and Second
Amendment, which expired on November 30, 2022 the same being CSC No. 52041-R3A2; the
Amendment to the Agreement allowed for a 3.0% cost increase to all inventory pricing;
WHEREAS, the parties desire to exercise the fourth one-year renewal term, effective
beginning on December 1, 2022 and ending on November 30, 2023;
WHEREAS, the Agreement provides for on-call mowing and litter services on either an
individual or recurring basis at pricing equivalent to comparable;
WHEREAS, the Contractor desires to provide certain on-call mowing and litter services
for the City in accordance with the terms of the Agreement and this Fourth Renewal and Third
Amendment;
WHEREAS, Contractor requested a unit price increase of 2.0% for work that it performs
at certain locations throughout the City;
WHEREAS, Contractor desires to provide certain litter only services for the City at a
discounted rate of 25% for all line items located in Exhibit C and any previous amendments; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for as follows: OFFICIAL RECORD

I.
The City and Contractor agree to renew and amend the Agreement for the fourth renewal
term of one year, effective beginning on December 1, 2022 and ending on November 30, 2023.
II.
All unit prices in Exhibit C of the Agreement, including any previous amendments if
applicable, pertaining to grounds maintenance are hereby amended to increase the pricing by
2.0% for all locations set forth in ITB/RFP No. 19-0033.
III.
All unit prices pertaining to litter only services in Exhibit C, including any current and
previous cost adjustments as well as any on-call amendments if applicable, of the agreement are
hereby amended to decrease the pricing by 25% for all locations.
IV.
Section 2.2, "SCOPE OF WORK", of the Agreement is revised to increase the aggregate
amount of the Agreement from$407,976.00 to $509,970.00 and is amended to read as follows:
"2.2 Contractor understands and agrees that the City will award non-
exclusive purchase agreements to multiple bidders for mowing and
grounds maintenance services as outlined in City of Fort Worth Bid
Solicitation (ITB/RFP No. 19-0033), which is attached to the Agreement
as Exhibit B, and incorporated herein for all purposes. Contractor further
understands that the aggregate amount of all contracts awarded to multiple
contractors under (ITB/RFP No. 19-0033) is in the amount of
$509,970.00, and the City makes no promise or guarantee of the total
amount of work that will be assigned to Contractor under this Agreement.
Contractor's Response to City of Fort Worth ITB/RFP No. 19-0033
("Contractor's Response") is attached to the Agreement as Exhibit C, and
incorporated herein for all purposes."
V.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this Fourth Renewal and Third Amendment.
2. All terms of this Fourth Renewal and Third Amendment that are capitalized but
not defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF,the City and Contractor have executed this Fourth Renewal
and Third Amendment to be effective on December 1st, 2022.
