DACW63-9-22-0663 DEPARTMENT OF THE ARMY CORPS OF ENGINEERS FORT WORTH DISTRICT Project: Benbrook Lake, Texas Tract No.C-240E CONSENT TO EASEMENT STRUCTURES WHEREAS, the United States has acquired a perpetual flowage easement over Tract No. C-240E, Benbrook Lake, Texas, which is recorded in Deed Records, Volume 3521, Page 77, of Tarrant County, Texas; and WHEREAS, said easement grants to the United States the right of prior approval for any structure to be located within the easement area, which area is under the administrative control of the Fort Worth District, U.S. Army Corps of Engineers; and WHEREAS, the United States has been requested to give consent to construct, operate, maintain, and repair two underground sewer pipelines, a wastewater lift station, and associated structures, on the above -identified tract. NOW THEREFORE, the United States hereby gives consent to City of Fort Worth, 200 Texas Street, Fort Worth, Texas 76102, to construct, operate, maintain, and repair two underground sewer pipelines, a wastewater lift station, and associated structures, at the location shown on EXHIBITS A — MAP, and 131 and B2 — DESIGN DRAWINGS, attached hereto: PROVIDED HOWEVER, that this consent is subject to the following conditions: 1. All activities conducted on the Premises shall comply with all applicable Federal, state, county and municipal laws, ordinances and regulations wherein the Premises are located. 2. The giving of this consent does not in any way subordinate the United States prior easement rights. The United States shall in no case be liable for any damage or injury to the structures herein consented to, which may be caused by any action of the United States under its easement, or that may result from future operations undertaken by the United States, and no claim or right to compensation shall accrue from such exercise of the United States' easement rights. 3. The United States shall not be responsible for damages to property or injuries to persons which may arise from or be incident to the exercise of the consented activity. This instrument is effective only insofar as the rights of the United States in the Premises are concerned; and the grantee shall obtain such permission as may be required on account of any other existing rights. It is understood that this consent does not eliminate the necessity for obtaining any Department of the Army permit which may be required pursuant to the provisions of Section 10 of the Rivers and Harbors Act of 3 March 1899 (30 Stat. 1151; 33 U.S.C. § 403), Section 404 of the Clean Water Act (33 U.S.C. § 1344), Section 408 (33 U.S-C. § 408) or any other permit or license which may be required by Federal, state, interstate or local laws in connection with the use of the Premises. 5. No fill material shall be brought in from above elevation 741 feet National Geodetic Vertical Datum, unless an equivalent amount has been excavated. Our intent is to preserve and maintain flood storage capacity. Excess material needs to be removed from Flowage easement. 6_ No area lying within the flowage easement shall be raised above 741 feet National Geodetic Vertical Datum, nor shall the elevation be altered in any manner. 7. All required permits and authorizing approvals, which may be required, shall be obtained by the requestor prior to the commencement of any work. 8. Following any open trench construction, the ground shall be returned to its existing state at the conclusion of this project. 9. This project estimates cutting approximately 1,108 cubic yards of soil and adding approximately 232 cubic yards of fill, resulting in a net flood storage gain of 876 cubic yards, as stated in EXHIBIT C — REQUEST LETTER. 10. When construction is completed The City of Fort Worth shall accept the completed sewer line and assume all operations and maintenance. 11. The Grantee is responsible for ensuring that the fully executed consent is officially recorded and filed in the county of record, and a copy is provided to the undersigned Real Estate Contracting Officer within 30 days of receipt. This letter conforms to the guidance document titled Requirements for Submitting Requests to Construct on Lands Encumbered with Flowage Easement issued by the Fort Worth District of the U.S. Army Corps of Engineers (USACE). The current landowner is WUSF 4 Rock Creek, LP, the applicant (developer) is DR Horton - TX, LTD., and the ultimate holder of the easements will be the City of Fort Worth. The proposed structures include two sanitary sewer lines to be installed below the existing grade, riprap to be installed below the existing grade associated with a road crossing adjacent to the flowage easement, and an excavated drainage channel. These structures will be installed associated with the construction of the proposed Rock Creek West residential development and will ultimately be owned and operated by the City of Fort Worth (hereinafter the "project"). Location The project is located west of the intersection of Old Granbury Road and Brewer Boulevard (Attachment A, Exhibits 1 through 4). The adjacent project includes proposed single-family residential lots and associated infrastructure to be constructed outside the limits of the USACE flowage easement. The controlling elevation listed within the flowage easement is 741'. Two sanitary sewer lines are proposed within the limits cf the flowage easement. One Iine will be a 24-inch gravity line, and the other will be a 16-inch force line. Both proposed sewer lines will parallel each other, and they also parallel an existing City of Fort Worth sanitary sewer line. Both proposed lines will begin inside the limits of the flowage easement near an existing lift station located approximately 0.40 miles southwest of the project. The sanitary sewer lines will extend northwest for approximately 580 feet within the flowage easement. The sanitary sewer lines then exit the flowage easement and continue northwest for approximately 1,450 feet, where they enter the flowage easement again. The sanitary sewer lines continue within the flowage easement for approximately 230 feet, where they exit the flowage easement and continues northwest remaining outside of the flowage easement (Attachment A, Exhibit 5 and Attachment B). The approximate 810 linear feet of the two proposed sanitary sewer lines located within the flowage easement will be installed below grade via trenching. Native soil excavated from the trench will be placed on top of the sanitary sewer lines to a point where the disturbed area matches the pre-existing contours after proper soil compaction. If any excess trench spoil material is present offer compaction, it will be exported outside of the flowage easement. There will be no loss of flood storage capacity associated with the installation of the sanitary sewer lines, and associated cut and fill will be balanced within the flowage easement (i.e., no loss of valley storage). There is a proposed road crossing located adjacent to the flowage easement Attachment A, Exhibit 5 and Attachment B. The majority of the grading and structure necessary to construct the road crossing is located outside of the flowage easement elevation. There are three 6'x5' RCB culverts proposed to be installed under the road crossing. These culverts will be placed slightly below the flowage easement elevation, resulting in the opening of the culverts to be located at the 741' elevation line. Riprap is required for stabilization on the downstream end of the road crossing. The area where the riprap will be installed will be excavated and installed below the flowage easement elevation. Excavation will include the export of 23 cubic yards of soil, which will be partially replaced by 17 cubic yards of rock riprap on the downstream side of the road crossing, resulting in a net removal (export) of 6 cubic yards from the flowage easement. Both the culverts and riprap will be placed of or below the 741' elevation line, resulting in no change to flood storage capacity or to the 741' contour line- ........... a ..................................................................... _......................... ................... ........................................................................................................................... The disturbed area associated with the proposed channel will be approximately 300' x 26.5' (Attachment A, Exhibit 5 and Attachment 8). The excavation will include the export of 1,085 cubic yards of soil, which will be partially replaced by 215 cubic yards of rock riprap, resulting in a net removal of (export) 870 cubic yards from the flowage easement. The drainage channel is being constructed outside the limits of USACE fee lands. The channel outfall will discharge into an existing stream channel and will be constructed in a manner that proposed discharges will be dissipated (i.e., through the installation of rock riprap and proper engineering practices) as to have no negative impact on the stream or USACE fee lands, which is approximately 0.5 miles downstream of fhe proposed outfall channel. Representative phofos of the area where the proposed disturbance would take place within the flowage easement are provided in Attachment C. Protection of the Environment DR Norton - TX, LTD. has taken precautions to protect the environment during the construction and installation of the proposed sanitary sewer lines, proposed rock riprap, and drainage channel. During the planning phase, environmental scientists from Peloton Land Solutions visited the project area to conduct tree surveys and general ecological evaivafions of the subject property. The sanitary sewer lines will cross waters of the U.S_ These crossings would be covered under the pre -construction notification for Nationwide Permit 58. The drainage channel ouffaii will discharge into a water of the U.S., and the road crossing will also impact waters of the U.S. DR Norton - TX, LTD. is working concurrently with the USACE Fort Worth District Regulatory Branch to obtain appropriate Section 404 permitting to construct these structures within wafers of the U.S. The habitats within the disturbed areas are not suitable for use by endangered or threatened species listed for Tarrant County. A stormwater pollution prevention plan fSW3P) will be prepared for the project and will be used during construction to reduce the potential for sedimentation of adjacent fiowage easement lands and downstream waters of the U.S. The SW3P will employ best management practices (BMPs) to stabilize soils and reduce the transport of sediment off - site. BMPs will be installed and constructed in accordance with the North Central Texas Council of Governments (NCTCOG) Integrated Storm Wafer Management (iSWM) manual for construction. Disturbed areas associated with the installation of the sanitary sewer lines, road crossing, and the excavation of the drainage channel will be stabilized and maintained according to sound land management practices. Excavated material exported outside of the limits of the USACE flowage easement will be placed in a manner to ensure that it will not be re -deposited through run-off or erosion back into the limits of the USACE flowage easement.
