FOURTH RENEWAL AND THIRD AMENDMENT OF CITY SECRETARY
CONTRACT NO. 52047,A NON-EXCLUSIVE MOWING AND GROUNDS
MAINTENANCE SERVICES AGREEMENT FOR NORTH DISTRICT TRAFFIC
DIVIDERS BETWEEN THE CITY OF FORT WORTH AND PRESTIGE WORLDWIDE
SERVICES,LLC.
This FOURTH RENEWAL AND THIRD AMENDMENT OF CITY SECRETARY
CONTRACT NUMBER 52047 ("Fourth Renewal and Third Amendment") is made and entered
into by and between the CITY OF FORT WORTH ("City"), a home-rule municipal
corporation of the State of Texas, acting by and through its duly authorized Assistant City
Manager, and PRESTIGE WORLDWIDE SERVICES, LLC. ("Contractor"), a Texas limited
liability corporation, acting by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract ("CSC")
Number 52047 ("Agreement");
WHEREAS, the primary term of the Agreement expired on March 4, 2020 and includes
four(4) one-year renewal options;
WHEREAS, the City and Contractor exercised a portion of the First Renewal Option,
which expired on November 30, 2020, the same being CSC No. 52047-R1;
WHEREAS, the City and Contractor exercised the Second Renewal Option and First
Amendment, which expired on November 30, 2021, the same being CSC No. 52047-R2A1; the
Amendment to the Agreement added new on-call inventory;
WHEREAS, the City and Contractor exercised the Third Renewal Option and Second
Amendment, which expired on November 30, 2022, the same being CSC No. 52047-R3A2; the
Amendment to the Agreement added new on-call inventory;
WHEREAS, the parties desire to exercise a fourth one-year renewal option, effective
beginning on December 1, 2022 and ending on November 30, 2023
WHEREAS, the Contractor desires to provide certain on-call mowing and litter services
for the City in accordance with the terms of the Agreement and this Fourth Renewal and Third
Amendment;
WHEREAS, Contractor desires to provide certain litter only services for the City at a
discounted rate of 30.0% for all line items located in Exhibit B and any previous amendments;
WHEREAS, Contractor requested a unit price increase of 5.0% for work that it performs
at certain locations throughout the City; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for one additional year as follows:

I.
The City and Contractor agree to renew and amend the Agreement for the Fourth
Renewal term of one year, effective beginning on December 1, 2022 and ending on November
30, 2023.
II.
Contractor will provide on-call mowing services in accordance with the terms of this
Agreement and Exhibit B-1, which is attached hereto and incorporated herein for all purposes.
All provisions related to on-call mowing services in the Agreement, including,but not limited to,
the non-exclusivity of the on-call mowing projects, remain in full force and effect.
III.
All unit prices in Exhibit B of the Agreement, including any previous On-Call
amendments if applicable,pertaining to grounds maintenance are hereby amended to increase the
pricing by 5.0% for all locations set forth in ITB/RFP No 19-0037.
IV.
All unit prices pertaining to litter only services in Exhibit B, including any current and
previous cost adjustments as well as any on-call amendments if applicable, of the agreement are
hereby amended to decrease the pricing by 30.0% for all locations.
V.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this Fourth Renewal and Third Amendment.
2. All terms of this Fourth Renewal and Third Amendment that are capitalized but
not defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this Fourth Renewal
and Third Amendment to be effective on December 1, 2022.
