SECOND RENEWAL AND SECOND AMENDMENT OF CITY SECRETARY
CONTRACT NO. 55538, A NON-EXCLUSIVE MOWING AND GROUNDS
MAINTENANCE SERVICES AGREEMENT FOR FORT WORTH POLICE STATIONS
BETWEEN THE CITY OF FORT WORTH AND SCOTT LANDSCAPE
MAINTENANCE, INC.
This SECOND RENEWAL AND SECOND AMENDMENT OF CITY
SECRETARY CONTRACT NUMBER 55538 ("Second Renewal and Second Amendment")
is made and entered into by and between the CITY OF FORT WORTH ("City"), a home -rule
municipal corporation of the State of Texas, acting by and through its duly authorized Assistant
City Manager, and SCOTT LANDSCAPE MAINTENANCE, INC. ("Contractor"), a Texas
corporation, acting by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract ("CSC")
Number 55538 ("Agreement");
WHEREAS, the primary term of the Agreement expired on November 30, 2021 and
includes four (4) one-year renewal options;
WHEREAS, the City and Contractor exercised the First Renewal Option and First
Amendment, which expired on November 30, 2022 the same being CSC No. 55538-R1A1; the
Amendment to the Agreement increased the contract amount to $37,500.00 and allowed for 3.0%
price increase on all inventory;
WHEREAS, the parties desire to exercise the second one-year renewal term, effective
beginning on December 1, 2022 and ending on November 30, 2023;
WHEREAS, the Contractor desires to provide certain on -call mowing and litter services
for the City in accordance with the terms of the Agreement and this Second Renewal and Second
Amendment;
WHEREAS, Contractor desires to provide certain litter only services for the City at a
discounted rate of 20.0% for all line items located in Exhibit B and any previous amendments;
WHEREAS, Contractor requested a unit price increase of 3.0% for work that it performs
at certain locations throughout the City; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for one additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the Second
Renewal term of one year, effective beginning on December 1, 2022 and ending on November
30, 2023.

II.
Contractor will provide on -call mowing services in accordance with the terms of this
Agreement and Exhibit B-1, which is attached hereto and incorporated herein for all purposes.
All provisions related to on -call mowing services in the Agreement, including, but not limited to,
the non -exclusivity of the on -call mowing projects, remain in full force and effect.
All unit prices in Exhibit B of the Agreement, including any previous On -Call
amendments if applicable, pertaining to grounds maintenance are hereby amended to increase the
pricing by 3.0% for all locations set forth in ITB/RFP No. 21-0037.
IV.
All unit prices pertaining to litter only services in Exhibit B, including any current and
previous cost adjustments as well as any on -call amendments if applicable, of the agreement are
hereby amended to decrease the pricing by 20.0% for all locations.
V.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this Second Renewal and Second Amendment.
2. All terms of this Second Renewal and Second Amendment that are capitalized but
not defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this Second
Renewal and Second Amendment to be effective on December lst, 2022.
