HomeMy WebLinkAboutContract 56870-A3AMENDMENT NO. 3 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES OLD HEMPHILL DROP-OFF STATION SCRAP METAL AREA MODIFICATIONS STATE OF TEXAS 56870-A3 CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant) made and entered into City Secretary Contract No. 56870 (The Contract) which was admiratively authorized for $39,410.00 for design services and did not include the reimbursable expenses as noted in Consultant's proposal, the 17th day of December, 2021, for Scrap Metal Area Modifications at the Old Hemphill Drop -Off Station; and Amendment No. 1 was administratively executed in the amount of $3,200.00 for reimbursable expenses that were inadvertently omitted in the Consultant's proposal; and Amendment No. 2 was administratively executed in the amount of $55,801.00 for modifications to the construction documents for additional scope of work; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for construction administration and estimating services; NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional design & construction administration services for the Old Hemphill Drop -Off Station. The cost of this additional services is $9,092.00 including $1,000.00 in additional reimbursable expenses. The scope of services is described more fully in Elements of Architecture, Inc.'s Letter dated December 8, 2022 (Revised) subject: Proposal for A/E Services — Hemphill Scrap Metal Yard — Amendment #3, Add Sery 02 — Additional CA and Cost Estimate. 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "C". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "C". However, the total fee paid by the City shall not exceed a total of $107,503.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." These services include providing a cost estimate as well as the additional CA Phase services needed for this additional effort. We have defined our additional scope of services beyond the original project scope as follows: SCOPE OF SERVICES Opinion of Probable Construction Cost - Provide at 95% submittal documents Construction Administration Phase 1. Proposals for civil, structural and cost estimating consultants are attached with the information included as if provided within this proposal. 2. The anticipated construction administration fee is based on an eight -month construction duration. If these phases extend beyond these anticipated schedules, we will provide a proposal for these extended services. PROPOSED FEE Labor We propose to provide our services as identified in this proposal for the lump sum amount as follows. This amount is in addition to our original proposal. DISCUSSION: The City of Fort Worth's Code Compliance Department has four existing Drop -Off Stations to serve the City. The existing facilities are the Brennan, Old Hemphill Road, Hilshire and the Southeast Drop -Off Stations. These improvements will include the addition of a new retaining wall, fencing and the design for a reinforced pavement parking lot for heavy equipment use, scrap metal storage and associated landscaping and irrigation of the area at the Old Hemphill Road location. Elements of Architecture, Inc., is one of five pre -approved architectural firms selected through a competitive Architectural Design Agreement selection process. Elements of Architecture was administratively contracted to assist with the Planned Development District modifications required for all Drop -Off Stations. Business Equity - Elements of Architecture, Inc. is in compliance with the City's Business Equity Ordinance by committing to 35\% MWBE participation on this project. The City's MWBE goal on this project is 35\%. Old Hemphill Drop -Off Station is located in COUNCIL DISTRICT 8 / FUTURE COUNCIL DISTRICT 9 and will serve Fort Worth residents in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Director of Finance Certifies that funds upon approval of the recommendations, funds are available in the current operating budget, as previously appropriated, in the Solid Waste Capital Projects fund. Prior to an expenditure being incurred, the Code Compliance Department has the responsibility to validate the availability of funds.
