Home My WebLink AboutContract 58625-A1Date Received: 4/6/2023 Time Received: 9.58 p.m. City Secretary Contract No.: 58625-Al FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58625 A COMMUNITY FACILITIES AGREEMENT BETWEEN THE CITY OF FORT WORTH AND ALTA MARINE CREEK OWNER, LLC This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58625 ("First Amendment") is made and entered into by and between the City of Fort Worth, ("City"), a home -rule municipal corporation of the State of Texas, and Alta Marine Creek Owner, LLC ("Developer"), a Delaware limited liability company. WHEREAS, the City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure improvements for a Project know as Marine Creek Apartments, City Secretary Contract Number 58625 ("CFA"); and WHEREAS, after execution of the CFA, Developer redesigned the Project and the City has approved new engineering plans for the Project; and WHEREAS, City and Developer desire to amend the CFA to reflect the revised scope of the Project; NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CFA: 1. Section 36 of the CFA is amended in its entirety to be and read as set forth in Attachment 1 of this First Amendment. 2. The Cost Estimates attached to the CFA are amended in their entirety to be and read as set forth in Attachment 2 of this First Amendment. 3. Exhibit A of the CFA is amended in its entirety to be and read as set forth in Exhibit A of this First Amendment. 4. Exhibit A-1 of the CFA is amended in its entirety to be and read as set forth in Exhibit A - of this First Amendment. OFFICIAL RECORD 5• CITY SECRETARY FT. Exhibit B-1 of the CFA is amended in its entirety to be and read as set forth in Exhibit B- of this First Amendment. 7. Exhibit C of the CFA is amended in its entirety to be and read as set forth in Exhibit C of this First Amendment. Contemporaneously with the execution of this First Amendment, Developer has delivered to the City additional administrative material testing costs in the amount of $1,127.00, additional water testing lab fees in the amount of $90.00 and a bond rider to increase the penal sum of the Development Bond provided to the City by Developer for the CFA to $662,553.12. 9. a. All other provisions of the CFA which are not expressly amended herein, shall remain in full force and effect. b. All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in the CFA.
