FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 57779
A COMMUNITY FACILITIES AGREEMENT BETWEEN
THE CITY OF FORT WORTH AND HT HWY 114 LAND 2, LP
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 57779
("First Amendment") is made and entered into by and between the City of Fort Worth ("City"),
a home -rule municipal corporation of the state of Texas, and HT Hwy 114 Land 2, LP, a Texas
limited partnership, and HT Hwy 114 Development LP, a Texas limited partnership.
WHEREAS, the City and HT Hwy 114 Land 2, LP entered into a Community Facilities
Agreement with City Participation for the construction of public infrastructure improvements for
a Project generally described as Tradition East — Offsite Sewer, City Project Number 103493, City
Secretary Contract Number 57779 ("CFA"); and
WHEREAS, pursuant to a certificate of merger filed with the Texas Secretary of State,
effective on October 14, 2022, HT Hwy Land 2, LP was merged into HT Hwy 114 Development
LP; and
WHEREAS, City, HT Hwy Land 2, LP and HT Hwy 114 Development LP desire to
amend the CFA to reflect the merger;
NOW THEREFORE, City, HT Hwy Land 2, LP, and HT Hwy 114 Development LP,
acting herein by and through their duly authorized representatives, enter into the following
agreement, which amends City Secretary Contract No. 57779:
1.
All references in the CFA to HT Hwy Land 2, LP are amended to be and read HT Hwy 114
Development LP.
2.
HT Hwy 114 Development LP will comply with, and as a result of the merger, has assumed
all duties and obligations of Developer set forth in the CFA
3.
All terms in this Amendment that are capitalized but not defined shall have the meanings
assigned to those terms in the CFA.

The CFA is in full force and effect and has not been modified, supplemented, or amended
in any way unless specifically set forth herein.

All notice which is required or desired to be sent to Developer under the CFA shall be
delivered to the following:

IN TESTIMONY WHEREOF, the City, HT Hwy Land 2, LP, and HT Hwy
114 Development LP have executed this First Amendment to be effective on October 14,
2022.
