FIRST AMENDMENT TO VENDOR SERVICES AGREEMENT BETWEEN
THE CITY OF FORT WORTH AND STEWART RANCH SERVICES
FORT WORTH CITY SECRETARY CONTRACT NO. 58832
This First Amendment to the VENDOR SERVICES AGREEMENT ("First
Amendment"), Fort Worth City Secretary Contract No. 58832, between the CITY OF FORT
WORTH ("City"), a Texas home rule municipal corporation and STEWART RANCH
SERVICES ("Vendor"), a Texas Limited Liability Company, each individually referred to as a
"party" and collectively referred to as the "parties."
WHEREAS City and Vendor entered into an agreement for forestry mulching services
for certain City property, said agreement being identified as Fort Worth City Secretary Contract
No. 58832 and having an effective date of February 7, 2023 (the "Agreement"); and
WHEREAS City and Vendor now wish to amend the Agreement for the first time to
extend the Agreement's term and deadline to complete the forestry mulching services.
NOW THEREFORE, City and Vendor, acting herein by and through their duly
authorized representatives, agree to the following terms:
1. Amendment of Term. "Section 2. Term." of the Agreement is amended to read as
follows:
This Agreement begins on January 30, 2023 ("Effective Date") and expires on December 31,
2023 ("Expiration Date"), unless terminated earlier in accordance with this Agreement
("Initial Term").
2. Amendment of Deadline to Complete Work. The Deadline to Complete Work in the
Agreement's Exhibit A — Scope of Services is amended to read as follows:
All mulching activities must be completed by December 31, 2023.
3. All other terms, provisions, conditions, covenants and recitals of the Agreement not
expressly amended herein shall remain in full force and effect. Total payment made under the
Agreement shall not exceed Forty -Six Thousand Four Hundred Thirty -Eight Dollars and
Fifty Cents ($46,438.50).
