CITY OF FORT WORTH
SECOND RENEWAL OF AGREEMENT
WHEREAS, the City of Fort Worth, ("City"), and Dannenbaum Engineering Corporation
n/k/a DE Corp, ("Contractor"), entered into that certain ORIGINAL AGREEMENT (City
Secretary #54136, M&C 20-0459) for the PROJECT generally described as: Water and Sewer
As-Built/Record Drawing Support, Part 1 Project and
WHEREAS, the ORIGINAL AGREEMENT may be renewed up to 3 times as provided
by M&C 21-0384 and
WHEREAS, the City of Fort Worth, ("City"), and Dannenbaum Engineering Corporation n/lda DE
Corp ("Contractor"), entered into that certain FIRST RENEWAL (City Secretary # 54136-R1,
M&C 21-0384)
WHEREAS, The City and Contractor desire to renew the ORIGINAL AGREEMENT for
an additional term at the same price and funding for said SECOND RENEWAL is available in
the budget of the Water and Sewer Capital Projects Fund, as appropriated in Ordinance # 25773-
09-2022.
NOW, THEREFORE, it is agreed by the City and Contractor as follows:
Article I
The Scope of Services as set forth in the ORIGINAL AGREEMENT has not changed.
Article II
The Contractor's compensation shall be in the amount up to $300,000,00. The Term of
this renewal agreement shall be effective as of the effective date and shall remain active until the
funds are expended or programmed.
Article III
There are no other changes to any other terms or conditions of the ORIGINAL
AGREEMENT.

SUBJECT:
(ALL) Authorize Execution of Amendment No. 1 to a Professional Services Agreement with Dannenbaum
Engineering Corporation n/k/a DE Corp to Provide for Three Renewal Terms, Authorize Execution of the
First Renewal in the Amount of $300,000.00 for Water and Sewer As -Built and Record Drawing Project,
Part 1 and Adopt Attached Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 to City Secretary Contract No. 54136, a professional
services agreement with Dannenbaum Engineering Corporation n/k/a DE Corp for the As -Built and
Record Drawing project, Part 1 (City Project No. 100258) to provide for up to three renewals of the
contract;
2. Authorize execution of the first renewal of City Secretary Contrat No. 54136 in the amout of
$300,000.00; and
3. Adopt the attached appropriation ordinance increasing receipts and appropriations in the
Water and Sewer Capital Projects Fund in the amount of $320,000.00, transferred from available
funds within the Water and Sewer Fund, for the purpose of funding the As-Built/Record Drawing
Support, Part 1 project (City Project No. 100258).
DISCUSSION:
On June 23, 2020, Mayor and Council Communication (M&C 20-0459), the City Council authorized a
professional services agreement with Dannenbaum Engineering Corporation n/k/a DE Corp in the amount
of $300,000.00 for Water and Sewer As -Built andRecord Drawing project, Part 1.
The agreement provided for the preparation of as -built record drawings for approximately 150 plan sets of
water and sanitary sewer drawings for developer and old capital improvements projects. As -built record
drawings were previously prepared by the Transportation and Public Works Department who no longer
has the staff for this work. As-built/record drawing preparation is now included in the scope of services for
Water Department design engineering agreements. This first effort was successful and staff desires for it
to continue.
This amendment and the first renewal will allow for the preparation of an additional 150 plan sets of as -
built record drawings out of the current backlog of drawings. In addition to the contract amount,
$20,000.00 (Sewer: $10,000.00; Water: $10,000.00) is required for project management. This project will
have no impact on the Water Department's operating budget when completed.

Business Equity: Dannenbaum Engineering Corporation n/k/a DE Corp agrees to maintain its initial SBE
commitment of 10 percent that it made on the original agreement and extend and maintain that same SBE
commitment of 10 percent to this first amendment. Therefore Dannenbaum Engineering Corporation n/k/a
DE Corp remains in compliance with the City's BDE Ordinance and attests to its commitment by its
signature on the Acceptance of Previous SBE Commitment form executed by an authorized representative
of its company.
The project is located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current operating budget in the Water &
Sewer Fund, and upon approval of the above recommendations and adoption of attached appropriation
ordinance, funds will be available in the W&S Capital Projects Fund for the As built and Record Drawing
project to support the approval of the above recommendations and execution of the amendment to the
engineering agreement. Prior to any expenditure being incurred, the Water Department is responsible to
validate the availability of funds.

(ALL) Adopt Appropriation Ordinance in the Amount of $320,000 to Fund the As-Built/Record Drawing
Support Project Contract Renewal and Effect a Portion of Water's Contribution to the Fiscal Years 2023-
2027 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council Adopt the attached appropriation ordinance increasing estimated
receipts and apprappropriations in the Water and Sewer Capital Projects Fund in the amount of $320,000,
transferred from available funds within the Water and Sewer Fund, for the purpose of funding the As-
Built/Record Drawing Support project (City Project No. 100258) Part 1 and to effect a portion of Water's
contribution to the Fiscal Years 2023-2027 Capital Improvements Program
DISCUSSION:

The agreement was subsequently revised by Amendment No. 1 and Renewal No.1 authorized by
M&C 21-0384 on June 8, 2021 that provided for up to three renewals of the contract and allowed for the
preparation of an additional 150 plan sets of as -built record drawings out of the current backlog. This
second renewal will provide for the preparation of an additional 180 plans of as -built record drawings out
of the current backlog. In addition to the contract amount, $20,000.00 (Water: $10,000.00; Sewer:
$10,000.00) is required for project management. This project will have no impact on the Water
Department's operating budget when completed.
It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of
within the annual budget ordinance, as projects commence, additional funding needs are identified, and to
comply with bond covenants. The actions in the M&C will appropriate funds in support of the Water's
portion of the City of Fort Worth's Fiscal Years 2023-2027 Capital Improvement Program, as follows:

Fund.
