SECOND AMENDMENT TO
CITY SECRETARY CONTRACT NO. 55658
BETWEEN THE CITY OF FORT WORTH
AND NEU ERA CONTRACT SERVICES, LLC
This Second Amendment to City Secretary Contract No. 55658 ("Second
Amendment") is made by and between the City of Fort Worth ("City"), a home -rule municipal
corporation of the State of Texas, and Neu Era Contract Services, LLC, a Texas limited liability
company ("Contractor"). City and Contractor are referred to individually herein as a "party" and
collectively as the "parties."
WHEREAS, New Era Contract Services, LLC entered into a non-exclusive mowing
services agreement, City Secretary Contract No. 55658 ("Agreement"); and
WHEREAS, the City consented to the assignment of the Agreement from New Era
Contract Services, LLC to Neu Era Contract Services, LLC, City Secretary Contract No. 55658-
CA I; and
WHEREAS, the City and Contractor renewed the Agreement for the first renewal term,
City Secretary Contract No. 55658-R1; and
WHEREAS, the City and Contractor renewed the Agreement for a second renewal term
and amended the Agreement to increase the prices for the Services due to inflationary costs, City
Secretary Contract Number 55658-A1R2; and
WHEREAS, City and Contractor have discovered an error in the price increases listed in
City Secretary Contract Number 55658-A1R2; and
WHEREAS, City and Contractor desire to amend the Agreement to correct the error in
the price increases and to reflect a price increase of 9.375%;
NOW THEREFORE, the City and Contractor, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends City Secretary
Contract No. 55658 as follows:

Exhibit B of the Agreement is hereby amended in its entirety to be and read as set forth in
Attachment 1 of this Second Amendment which is attached hereto and incorporated herein by
reference.

a. All other terms, provisions, conditions, covenants and recitals of the Agreement not
expressly amended herein shall remain in full force and effect.

b. Terms in this Second Amendment that are capitalized, but not defined, shall have the
meanings assigned to those terms in the Agreement.

This Amendment may be executed in multiple counterparts, each of which shall be an
original and all of which shall constitute one and the same instrument. A facsimile copy or
computer image, such as a PDF or tiff image, of a signature, shall be treated as and shall have the
same effect as an original.
Executed to be effective on April 29, 2023.
