AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 58611
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and
Associates, Inc., (ENGINEER) made and entered into City Secretary
Contract No. 58611, (the CONTRACT) which was authorized by M&C 22-0944 on
the 29th day of November, 2022 in the amount of $ 638,532; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Bomber Spur Trail Phase 1, CPN 104345; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by ENGINEER totals $45,273. (See Attached Funding
Breakdown Sheet, Page -4-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to ENGINEER for all work and services performed under
the CONTRACT, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $683,805.
3.
All other provisions of the CONTRACT, which are not expressly
amended herein, shall remain in full force and effect.
EXECUTED and EFFECTIVE as of the date subscribed by the City's
designated Assistant City Manager.

ATTACHMENT "A"
Bomber Spur Phase II Boundary Survev and Acauisition Assistance
PART 1 — OVERAL PROJECT DESCRIPTION
The goal of this project is to perform the boundary survey and meets and property/easement
acquisition metes and bounds survey maps for Phase II of the Bomber Spur Trail. Phase 11
is from the end of Phase I to Vickery Boulevard for approximately 1.3 miles.
PART 2 - SCOPE OF SERVICES
Task 1 — Boundary Survev
A) ENGINEER will, via a subconsultant:
a. Survey Coordination. The ENGINEER will coordinate with the City and
Streams and Valleys to develop a concept exhibit for each potential
acquisition.
b. Research the subject property and all adjoining properties and obtain copies
of plats, easements, and deeds. Prepare a working sketch to locate property
corners and establish existing boundary/right-of-way/easement lines.
c. Deliverables will consist of a digital file in dwg format containing existing
boundary/right-ofway/easement lines. Other deliverables will consist of a copy
of all field notes and drawings, and an ascii point file of all points located in the
survey.
d. Prepare 11 "x17" sheets summarizing property/easement/ownership data
indicating location and property boundary/easement limits for all subject
properties within the Phase II corridor.
Task 2 — Acquisition Assistance
Engineer will prepare various metes and bounds description with exhibit for properties that
are mapped on Page 3 of Attachment A and described below:
A) Prepare a metes and bounds description with exhibit for the USA Right -of -Way
Easement described as Tract No. 6., to be conveyed to the City of Fort Worth. All
property corners will be marked with 5/8 inch iron rods with caps stamped with
surveyors name.
B) Prepare a metes and bounds description with exhibit for the USA Right -of -Way
Easement described as Tract No. 5., to be conveyed to the City of Fort Worth. All
property corners will be marked with 5/8 inch iron rods with caps stamped with
surveyors name.
C) Prepare a metes and bounds description with exhibit for the USA Right -of -Way
Easements described as Tract No. 2, 3 and 4, to be conveyed to the City of Fort
Worth. All property corners will be marked with 5/8 inch iron rods with caps stamped
with surveyors name.

Attachment B
Compensation
The services of Bomber Spur Phase I Amendment 1 described in Attachment A Scope of
Services shall be provided for a total lump sum fee of $45,273. The ENGINEER reserves
the right to reallocate budgets amongst tasks. The overall fee total shown shall not be
exceeded without prior written authorization from the CITY. All permitting, application,
and similar project fees will be paid directly by the CITY.
Payment for the services of Phase I described in Attachment A Scope of Services shall
be invoiced to the CITY on a monthly basis, based upon percentage completed for each
task. ENGINEER shall provide the CITY a one -page project status report along with the
submittal of monthly invoice throughout the design and construction of the project
Below is a fee breakdown by task for the services of Bomber Spur Phase I Amendment
1 described in Attachment A Scope of Services:
