CITY OF FORT WORTH
FIRST AMENDMENT OF CONTRACT
WHEREAS, the City of Fort Worth, ("CITY") and Westhill Construction, Inc.,
("CONTRACTOR") entered into a construction contract, City Secretary No. 57215, effective
on March 03, 2022 ("CONTRACT") which was authorized by M&C 22-0100on February 8,
2022; and
WHEREAS, the City of Waxahachie, Texas, by email conununication dated April 27,
2023, desires to utilize said Contract under the co-operative purchasing rules of the State of
Texas to which the City of Fort Worth does not object; and
WHEREAS, the Contractor, by letter dated April 17, 2023 agrees to perform for the
City of Waxahachie, Texas; and
WHEREAS, the CITY and CONTRACTOR desire to amend the CONTRACT to
provide for the ability of the City of Waxahachie, or any other proper legal entity, to access
and use the Contract;
NOW, THEREFORE, it is agreed by the CITY and CONTRACTOR as follows:
Article I
Section 00 52 43 — AGREEMENT to the CONTRACT is hereby amended by
adding a Section Numbered 7.14, as follows:
Should other Governmental entities decide to participate in this contract, the Contractor
hereby agrees that that all terms, conditions, specifications, and pricing shall apply.
Article II
There are no changes to any other provisions of the CONTRACT.
