WHEREAS, the City of Fort Worth, a home rule municipal corpora-
tion of Tarrant County, Texas, requested that the Fort Worth
Independent School District, a political subdivision in Tarrant
County, Texas, hereinafter called "Lessor", lease to the City of
Fort Worth, hereinafter called "Lessee" , a certain .tract of land for
the use and maintenance of same as a public recreational area; and
WHEREAS, at a regular meeting of the Fort Worth City Council
held on May 23, 1978, said Council approved said request; and
WHEREAS, at a regular meeting of the Board of Education of the
Fort Worth Independent School District on May 24, 1978, regarding
the leasing of said tract by Lessor to Lessee, said Board approved
said request;
NOW, THEREFORE, KNOW
ALL MEN BY THESE PRESENTS:
That this agreement, contract and lease is made and entered
into by and between the Lessee, acting herein by and through Robert
L. Herchert, its duly authorized' City Manager, and Lessor, acting
herein by and through its duly authorized President of the Fort
Worth Board of Education;

That for and in consideration of the payment by Lessee to
Lessor of the sum of One and No/100 Dollars ($1.00) per annum as
lease rental, Lessor hereby leases and demises unto Lessee the use
of a tract of land located in Tarrant County, Texas, such tract
being more particularly described in the field notes marked Exhibit
"A" and outlined in red on the plat marked Exhibit "B" , both
Exhibits being attached hereto and incorporated herein for all
purposes incident to this lease agreement.

1.
The term of this lease shall be for twenty (20) years, com-
mencing on the 15th day of February, A.D. 1979 and terminating on
the 14th day of February, A.D. 1999. Payment of the annual rental
shall be made at the Administrative Office of the Board of Education
of the Fort Worth Independent School District, 3210 W. Lancaster
Street, Fort Worth, Tarrant County, Texas.

This lease shall be subject to all existing easements for
public roads, channels, highways, public utilities, railroads,
pipelines and electrical transmission lines.

As additional consideration for the making of this lease, the
Lessee will construct at its expense such recreational facilities as
the said Fort Worth City Council may hereafter authorize and
determine. It is understood and agreed that the nature and extent of
the recreational facilities now or hereafter to be constructed by
the Lessee on the demised premises shall be within the discretion of
Lessee.

Lessee covenants and agrees that it will not make or suffer any
waste, .unlawful, improper or offensive use of the demised premises
or any part therof; and Lessee shall comply with all ordinances and
regulations of the City of Fort Worth and with the laws of the State
of Texas and of the United States of America applicable to the use
of said premises.

Lessee agrees to begin construction on such recreational
facilities on the demised premises within four (4) years after the
execution date of this lease agreement. In the event such
improvements are not begun within the prescribed time, then this
lease agreement shall terminate and neither party shall have any
future responsibilities thereunder.

Lessee shall have exclusive right, title and interest in all
structures and improvements constructed on the demised premises by
Lessee.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement at Fort Worth, Tarrant County, Texas, on this
day of A.D. 1979.

Background
Cooperation between the Fort Worth Park and Recreation Department and the
Fort Worth Independent School District in the joint acquisition, development,
maintenance and/or sharing of facilities and services has been a matter of
long-standing agreement between the two public agencies. Although most
agreements existed only informally, reciprocity between the two entities dates
back more than fifty years.
Many similarities can be seen in the number, type and use of physical properties
owned and administered by the two agencies such as neighborhood and community
parks and open spaces provided at school sites; buildings (gymnasiums); athletic
facilities, including ballfields, football-soccer fields, track and tennis
facilities; and certain program areas such as nature interpretation. Some
facilities are owned and operated separately by one entity with use being
extended to the other at reduced rates or for free. These facilities include
baseball fields, golf courses, McLeland Tennis Center, Zoo, Log Cabin Village,
and Fort Worth Nature Center and Wildlife Refuge which the City shares with the
schools. School-owned tracks, undeveloped sites, gyms,:and .stadiums.:are :shared
with Parks and Recreation. The two agencies have cooperated in purchasing
adjacent land, land transfers, and development projects.
Major bond programs recently have been passed by both entities. Many facilities
proposed in the respective programs are similar in terms of type of facility and
citizens to be served. Further, peak use of some facilities on a daily and
seasonal basis occurs at different times. Costs of land, construction, operation
and maintenance of park and recreational facilities are rising at a rapid rate.
Continuing inflation will adversely affect the number and quality of projects
accomplished by each agency. To make better use of bond monies and tax dollars,
reduce unnecessary duplication of facilities, and provide more and better
facilities for citizens, it is advantageous to each agency to support a cooper-
ative development, use and maintenance program for certain facilities. To meet
legal requirements, each agency will retain appropriate independence and integ-
rity in all joint projects.
Proposed Program
Joint school and park staff meetings have been held to discuss several possible
cooperative projects, including extensive development of tennis facilities,
athletic fields and playgrounds. To insure mutual understanding of responsibi-
lity, a detailed land use, development and maintenance agreement has been
irepared for each proposed project.

Proposed Joint Tennis Facilities
A major need in Fort Worth is for additional tennis facilities.
To meet some of these needs, it is proposed to locate various tennis courts as
follows:
1. Proposed Sites
A. Southwest High School (Total of 8 tennis courts)
Fort Worth ISD i
Will renovate four tennis courts and provide land to the
City by lease agreement for the construction of four new
courts.
Fort Worth Park and Recreation Department
Will build four new tennis courts on school property and
light four to six courts.
B. Pasebal .High School (Total of 8-tennis courts)
Fort Worth ISD
Will renovate three existing tennis courts, build three
new tennis courts, and,prbvide land to the City by lease
agreement for the construction of two new courts.

J. Dunbar High School and the adjoining Bunche Park

Will renovate four existing tennis courts and build two new
concrete courts. FWISD will lease land from the City for the
two new courts.
Fort Worth Park and Recreation Department
Will lease land to FWISD for two tennis courts.
2. Location of Courts on Campuses
The site of the courts on each campus will be mutually agreed upon
by the FWISD and the Park and Recreation Department. The courts, where
possible, will be located adjacent to existing courts.
3. Construction
A. New Courts
The new courts listed above will be of concrete construction'-with
specifications to be mutually agreed upon by the FWISD and the Park
and Recreation-Department. Construction will include court surfacing,
court stripping, court fencing and metal court nets.

B. Renovation of Existing Courts
As for renovation of existing courts, such work will consist of
resurfacing, court stripping, repair of fencing and installation
of metal nets.
4. Lighting (Southwest High School Only) -
Because the lighting will be primarily for night time public use,
the Park and Recreation Department will install lighting for four
to six courts, provide all maintenance for lighting, and provide
electricity. The lights will be operated from a steel control box
with an on/off control button and anr-electric timer which will turn
the electricity off at a pre-set time.
5. Maintenance of Tennis Courts
A. Routine Maintenance on Daily Basis
Routine maintenance includes tightening of nets and keeping
courts clean. FWISD will provide routine maintenance from
September l to May 31 each year for the courts in this proposal.
The Park and Recreation Department will provide routine
maintenance from June 1 to August 31.
B. Major Repairs
As for major repairs, representatives of each agency will perform
an on-site inspection of the joint tennis facilities each year
during January to determine maintenance needs. The post of necessary
maintenance will be equally shared by the agencies. Emergency
maintenance due to vandalism or other destructive forces will be
managed as outlined in 5A above.
6. Use Agreement
The courts will be available for school use for physical education and
athletics on school days. The courts will be. available for public use
during late afternoon and evening hours on school days, and all day
Saturdays and Sundays. During the summer months, the courts will be
available daily for public use. The courts will be available to the
schools in late afternoon, evenings and Saturdays for tournament play
as required on occasion.

Athletic Facilities
1. Proposed Sites
A. 0. D. Wyatt High School and the adjoining Rolling Hills Park
Fort Worth ISD
Will return lease on 9.5 acres recently obtained from the Park
and Recreation Department retaining only that portion of the
land required to construct eight new tennis courts.
Will provide lease land on Seminary Drive on which Park and
Recreation Department will construct 50-car parking lot.
Fort Worth Park and Recreation Department
Will construct two lighted combination ball fields which will
accommodate football, soccer, and baseball games. Each field
will consist of backstops, concrete bleacher pad, bleachers,
concrete player seating area and walks.
Will construct 50-car parking lot.
May provide additional open space (approximately 18 acres) south
of the athletic complex described above which would be available
to FWISD under use agreement. The FWISD will install fencing at
the narrowest point separating the existing City greenhouse to
the south and the open space to the north, and would provide
mowing.
B. Dunbar High School and the adjoining Bunche Park.
Fort Worth ISD
Will provide lease and use agreement for the renovation of the
existing baseball field. (Part of the field` now is located on
park property.)
Fort Worth Park and Recreation Department
Will renovate the baseball field by providing lighting, backstop,
dugouts, concrete player seating area, concrete bleacher pad and
bleachers.
2. Existing Maintenance and Use Agreement
The existing maintenance and use agreement between FWISD and the Park and
Recreation Department for Rockwood, Trinity and Southwest Ballfields will
be extended to include 0. D. Wyatt/Rolling Hills Park and Dunbar/Bunche
Park.

Playgrounds and Land Use Agreement
1. Location of Playgrounds
A. Ridglea Hills Elementary and the adjoining Ridglea Hills Park
Fort Worth ISD
Will provide, if requested, a lease agreement to the City for
land to construct two concrete tennis courts south of the new
activity building. The school district will provide a lease
agreement to the City for the construction of a concrete multi-
purpose playground slab (approximately 3000 sq. ft.) on a site
to be determined by the District. The FWISD will provide main-
tenance for the multi-purpose slab and basketball backboards
placed on the slab.
Fort Worth Park and Recreation Department
Contingent upon an approved development plan, the Department
will build two concrete tennis courts and a concrete play slab
(approximately 3000 sq. ft.) on school property. The Park and
Recreation Department will construct a 12 to 15 car parking lot
on park property, a portion of which may be used for school
parking during school hours. The Department will construct a
school/park playground and an exercise track on park property.
Playground equipment to be installed will be mutually agreed
upon by both agencies.. The Department will provide maintenance
for the tennis courts, playground equipment, and track.
B. Western Hills Elementary
Fort Worth ISD
Contingent upon an approved development plan, the District will
leaseone acre of property on the northwest corner of the campus
to the City. The area currently is occupied by portable buildings
formerly used to house the Dean School. The FWISD will provide a
use agreement to the Park and Recreation Department for the playground
area.
Fort Worth Park and Recreation Department
Will construct a school/park playground on land leased from the
schools. The Park and Recreation Department will construct a
multi-purpose concrete play slab (approximately 3000 sq. ft.) on
a site to be determined by the District. The Department will
upgrade existing backstops, add soccer goals, and provide
additional grounds improvements, such as soil and reseeding. The
Department also intends to purchase 2 to 3 acres of land adjoining
the school property for park purposes.

If the Department proceeds to build the playground, they will
pay to relocate the buildings to sites designated by FWISD.
C. Eastern Hills Elementary
Fort Worth ISD
Will provide a land lease agreement to the City for the
wooded area located on the north side of the school
property. The District also will provide a lease agreement
to the City for the construction of four tennis courts.
Fort Worth Park and Recreation Department
Will construct a school/park playground on land leased from
the District. The two agencies will mutually agree upon
playground equipment to be installed.
D. M. G. Ellis School Site
Fort Worth ISD
Will provide a use agreement to the City for the existing
Park and Recreation baseball field.
Fort Worth Park and Recreation Department
Will provide renovation of the field and will provide main-
tenants for all the grounds west of the M. G. Ellis building.
E. Ridgmar School Site (5.9 acres)
Fart Worth 'ISD
Will lease three acres (north side of property) to the City
for a school/park playground. The lease will be for twenty
years. The FWISD will provide a use agreement to the City
for the remaining two and nine-tenths acres.
Fort Worth Park and Recreation Department
Will construct a school/park playground and playground ball
field. The equipment to be placed on the playground will be
mutually agreed upon. The City will be responsible for the
maintenance of the equipment and property.

F. Thomas Place (Site of Classroom Teachers'Offices)
Fort Worth ISD
Will lease the grounds to the City for a neighborhood park.
The lease will be for twenty years. If it becomes necessary
for the FWISD to terminate the lease, the District will pay
relocation costs of any equipment installed on the park site.
Fort Worth Park and Recreation Department
Will construct a neighborhood park on the land south and east
of the building. The City will provide maintenance for all
the grounds. The area vast of the building will continue to
be used for classroom teacher parking.
G. Chamberlin Park (Como High Football Field)
Fort Worth ISD
Will change the use agreement to a twenty-year lease agreement
for the land that was the Como High School athletic field (located
6 blocks south of the Como schools).
Fort Worth Park and Recreation Department
Will continue to develop the property into an athletic field
and will provide all maintenance for the property.
H. Meadowood
Fort Worth ISD
Will change the use agreement into a twenty-year lease agreement.
Fort Worth Park and Recreation Department
Will construct a neighborhood playground and park.
I. Carver Elementary
Fort Worth-ISD
Will lease for 20 years from the City the property west of
Carver Elementary School. The approximate .5 acre of land
(Smith Hirshfield Addition Block 3, Lot 4, 5, 6) is bounded
on the east by Steadman, on the south by 13th Street, and on
the west by the North Freeway Access Road.
The FWISD will build a parking lot for the faculty of Carver.
The District will provide all maintenance on the lease property.

Will provide a 20-year lease of the land west of Carver Elementary
as described above.
J. Federal Depot Property/Greenbriar Park
.Fort Worth ISD
Will lease 3.1 acres of previously dedicated Federal land from
the City. The land will be adjacent to land already dedicated
to the District.
Fort Worth Park and Recreation Department
Will lease 3.1 acres of previously dedicated Park and Recreation
Federal Depot property to the FWISD.
Will study the feasibility of locating a proposed activity center
in close proximity to the school property so the facility could
be utilized by the District when needed.
The two agencies will study the feasibility of a joint venture to
provide an access road to the park and school property.
K. Bruce Shulkey Elementary and adjoining Wedgwood Park
Fort Worth ISD
Will provide assistance in the design of the playground and
exercise track.
Fort Worth Park and Recreation Department
Will construct on park property a joint use playground, exercise
track and two concrete tennis courts.
Z. Maintenance Agreement on Playgrounds
The Park and Recreation Department will provide all maintenance on leased
playgrounds and playground equipment.
The FWISD will provide maintenance on leased land and on the multi-purpose
slabs and basketball backboards and goals located on the slabs.
3. Use Agreement on Playgrounds
The playgrounds will be located so that general public use will not inter-
fere with school activities during school hours.
The FWISD will use the playgrounds, multi-purpose slabs, and exercise
tracks during school hours. The facilities will be available to the
public at all other times.

Independent School District
Terms of Lease Agreements
Reciprocal land lease agreements will be for a period of twenty years. The
lease fee shall be one dollar ($1.00) per year recited only as a formality
on each project.
Schedule of Construction
On all cooperative projects, the District and Park and Recreation Department
will coordinate work so that project development plans, site plans and
construction plans will I— -ritually benefi,ial. Governing authorities of
the FWISD and the Ci,:y will continually review and work toward expanding the
proposals contained in this agreement.
The FWISD will proceed with the designing of the new courts and renovation of
existing courts, with construction to be completed by the end of 1978.
The Park and Recreation Department will complete construction drawings in
November, 1978, and begin construction in February, 1979.
Funding
I. Tennis Facilities
Southwest High School: Construct 4 courts and light 4 to 6 courts at
a cost of $78,000; CIP funds exist in Wedgwood Park ($83,000), CandleRidge
Park ($351,000), Southwest Park ($31;000); application will be made for
federal (H.C.R.S.) matching funds on these projects; use of $78,000 in
Bond funds for tennis court..cbnstruction.
Paschal High School.: Construct 2 courts at a cost of $24,000; CIP funds
exist in Forest Park ($339,275); application will be made for federal
(H.C.R.S.) matching funds on this project; use of $24,000 in bond funds
for tennis court construction.
Diamond Hill - Jarvis High School: Construct 2 courts at a cost of $24,000;
Community Development fund's exist for Diamond Hill ($75,000 in year IV);
application will be made for federal (H.C.R.S.) matching funds; use of
$24,000 in Community Development funds for tennis court construction.
Arlington Heights High School: Construct 2 courts at a cost of $24,000;
CIP funds available in Trinity Park ($165,000); application for federal
(H.C.R.S.) matching funds on this project; use $24,000 in bond funds for
tennis court construction.
Eastern Hills High School: Construct 4 courts at a cost of $48,000; land
lease from FWISD for neighborhood park results in land acquisition savings;

from FWISD for neighborhood' park will result in land acquisition savings
(Thomas Place School); $42,750 CIP funds exist in Arlington Heights Sector
for park development; application will be made for Federal grant funds to
fully develop park and tennis courts.
Stripling Middle School: Construct 2 courts at a cost of $24,000; CIP funds
exist in Berney Park ($28,000); application will be made for matching funds
to develop park and tennis courts.
There are 20 tennis courts to be constructed by Park and Recreation Department
at a total estimated cost of $270,000.
22... Athletic Facilities
0. D. Wyatt High School: Construct a ballfield complex containing 2
lighted fields which will be used for baseball, football, and soccer,
plus a 50-car parking lot at a cost of $175,000; CIP funds for this project
exist in Highland Hills Park and in Park Drive Bonds; Federal matching funds
(H.C.R.S,) will be applied for based upon $74,000 in road work for Highland
Hills Park.
Dunbar High School/Bunche Park: Renovate existing ballfield (a part of the
ballfield is already.on park property); Community Development and B.O.R.
funds already are available,for- this'`-projec•t. eatimated'td'cbst"$25,000.
Playgrounds and Land Use Agreements
CIP funds already have been approved for all proposed playground
construction. Land leased from the F41ISD for park or playground
construction will result insubstantial savings in land acquisition.
Application for Federal (H.C.R.S.) matching funds will be submitted
on all projects.
Summary
In all cases parks will be acquired and/or developed in accordance with the
approved 1978-81 Park and Recreation C.I.P. Land leased from the FWISD
(instead of land purchase), joint construction of facilities, and hederal
(H.C.R.S.) matching fund programs will provide more and better facilities
beyond those approved in the 1978-81 C.I.P. The specific bond allocations,
grant applications, and construction contracts will be presented to the Council
for approval at the approrpiate times.

Conclusion
The above outlined program is designed to benefit the residents of the
City of Fort Worth. This cooperative effort will provide more funds for both
the City and FWISD with development and maintenance costs equally distributed
between the two governmental bodies.
Recommendation I.
It is recommended that the City;; Council approve the proposed program as outline
above and authorize the City Manager to prepare and execute the necessary lease/
use agreements with the Fort Worth Independent School District and proceed with
development.
