HomeMy WebLinkAboutContract 15651 JOINT RESOLUTION AND AGREEMENT CITY SECRETARY _ THE STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("Fort Worth") is a home rule city lying and being situated within the confines of the County of Tarrant, State of Texas; and WHEREAS, Fort Worth and Haslet each desires to adjust its respective corporate boundaries and extraterritorial jurisdiction ("ETJ") in the manner set forth herein to facilitate the development and maintenance of property within their respective jurisdictions; and WHEREAS, such adjustments are permitted under the laws of the State of Texas, including without limitation, Article 970a, Texas Revised Civil Statutes; and WHEREAS, such adjustments are in the best interest of both Fort Worth and Haslet; NOW, THEREFORE, BE IT RESOLVED AND AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE TOWN OF HASLET; Section 1. Haslet' s ETJ shall be and is hereby expanded to encompass—tie entire territory described in Exhibit "A" (containing metes and bounds description and map) attached hereto anti incorporated herein by reference for all purposes (the "Haslet ETJ Expansion Area"). Said expansion shall become effective immediately as and to the extent permitted by law. If the Haslet ETJ cannot immediately be expanded to the full extent of the Haslet ETJ Expansion Area due to statutory or other restrictions, then Haslet may expand its ETJ to the full extent of the Haslet ETJ Expansion Area in phases from time to time as Haslet is legally permitted to do so. Fort Worth shall release its ETJ in the Haslet ETJ Expansion Area from time to time if, as and to the extent that Haslet is legally permitted to expand its ETJ into the Haslet ETJ Expansion Area. Upon written request by Haslet, Fort Worth shall immediately execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Haslet to effectuate and evidence such release. i Section 2. Subject to the provisions of Section 4 below, Fort Worth's ETJ shall be and is hereby expanded to encompass the entire territory described in Exhibit "B" (containing metes and bounds description and map) attached hereto and incorporated herein by reference for all purposes (the "Fort Worth ETJ Expansion Area") . Said expansion shall become effective immediately, except for the portion thereof that is the Disannexation Tract (defined below) , which tract shall become a part of Fort Worth' s ETJ as provided in Section 3 below. Haslet shall , and does hereby, release its ETJ in the Fort Worth ETJ Expansion Area, subject to the provisions of Section 3 below regarding the Disannexation Tract. Upon written request by Fort Worth, Haslet immediately shall execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Fort Worth to effectuate and evidence such release. A portion of the Fort Worth ETJ Expansion Area is subject to being released to Haslet pursuant to the conditions set forth in Section 4. Section 3. A portion of the Fort Worth ETJ Expansion Area presently is within the city limits of Haslet as described on the attached Exhibit "C" (containing metes and bounds description and map), hereinafter refe— rre�lc. to as the "Disannexation Tract." Haslet shall disannex the Disannexation Tract. Haslet shall proceed with due diligence to conduct all proceedings and adopt all ordinances necessary to effect such disannexation as promptly as possible. Upon such disannexation becoming effective, the Disannexation Tract immediately shall constitute a part of Fort Worth' s ETJ, and Haslet shall release any ETJ rights or interest it may have in such tract effective as of the date of disannexation. Upon written request by Fort Worth, Haslet immediately shall execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Fort Worth to effectuate and evidence such release. Section 4. A portion of the Fort Worth ETJ Expansion Area eventually may be used for an airport, and, if such airport is constructed, another portion of the Fort Worth ETJ Expansion Area described on the attached Exhibit "D" (containing metes and bounds description and map) may be used for the future construction of an additional runway (the "Additional Runway Tract") . In the event construction of the airport runway on the Additional Runway Tract has not commenced (meaning commencement of the pouring of concrete for the runway itself) within 15 years after the date of the adoption of this Joint Resolution by Fort Worth, the Additional Runway Tract shall become a part of the Haslet ETJ , and Fort Worth promptly shall release its ETJ in the Additional Runway Tract and, if necessary, disannex the Additional Runway Tract so that it can become a part of the Haslet ETJ. If disannexation is required, Fort Worth shall conduct all proceedings and adopt all ordinances necessary to effect such disannexation. If such release is to become effective, Fort Worth shall execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by Haslet to effectuate and evidence such release. Section 5. As part of its approval process, the Federal Aviation Administration (the "FAA") may require the realignment of the runway on the above referenced airport. The portion of the boundary of the Haslet ETJ Expansion Area between point "A" and point "B" as shown on Exhibit A includes the western boundary of the airport (the "Western Airport Boundary") . In the event that the FAA requires a realignment of the runway (the "Realigned Runway") after the date that this resolution is passed and approved by the parties hereto, the City of Fort Worth and the Town of Haslet agree to take all measures necessary to adjust the Western Airport Boundary so that its new location bears generally the same relation to the Realigned Runway as the western airport boundary shown in Exhibit "E" bears to the runway shown in Exhibit "E" (the "Realigned Western Airport Boundary") . In the event of a runway realignment, it is the intent of the parties that the boundary of the Haslet ETJ Expansion Area will be adjusted to include the Realigned Western Airport Boundary so that the entire airport will be located within the ETJ of the City of Fort Worth. The City of Fort Worth and the Town of Haslet agree to execute such instruments, enact such ordinances, conduct such proceedings and adopt such resolutions as may be reasonably requested by the other party to effectuate the above-stated intent of the parties. Section 6. Fort Worth and Haslet hereby covenant to protect, preserve a defend the ETJ and municipal boundaries agreed to herein. Section 7. The agreements hereinabove set forth shall become binding upon Fort Worth and Haslet upon the adoption of this Joint Resolution in regular open City Council meetings of both Fort Worth and Haslet, shall be executed in several originals and shall be set out in full in the minutes of both Fort Worth and Haslet. A copy of this Joint Resolution shall be executed by the Mayor and attested by the City Secretary of both Fort Worth and Haslet. Approve the attached Joint Resolution and Agreement between the City of Fort Worth and the Town of Haslet to adjust the corporate boundaries and extraterritorial jurisdiction of said cities; and 2. Direct staff to prepare an annexation ordinance in order to accomplish the proposed boundary adjustment. .Discussion: At the present time, the City of Fort Worth does not have a boundary or extra- territorial jurisdiction agreement with the Town of Haslet, with respect to overlapping extraterritorial jurisdiction. According to Article 970a of the Revised Civil Statutes of the State of Texas, overlapping extraterritorial jur- isdiction must be partitioned among cities prior to annexation of territory within the overlapping jurisdiction of those cities. In order to facilitate the proposed annexation, and development of the North Fort Worth Airport site, a boundary and extraterritorial jurisdiction agreement with the Town of Haslet will be required because of overlapping extraterritor- ial jurisdiction and because a portion (57.767 acres) of the proposed airport site lies within the Town of Haslet and is to be annexed by the City of Fort Worth. The Joint Resolution and Agreement contains four (4) exhibits. Exhibit "A" describes Haslet' s expanded extraterritorial jurisdiction ("ETJ") area. Exhibit "B" defines Fort Worth' s expanded ETJ including the 57.767 acres to be disannexed by Haslet. Exhibit "C" describes the area within the City limits of. Haslet which Haslet will disannex and which will become a part of Fort Worth' s ETJ. Exhibit "D" describes an area within the Fort Worth ETJ Expanded Area to be used for an additional runway in the future. If it is determined that the runway is not required, said land shown in Exhibit "D" will become a part of Haslet' s ETJ at some future date. The attached Joint Resolution and Agreement is scheduled to be considered for approval and adoption by Haslet at its City Council meeting of April 13, 1987. An additional request has been made by Mr. H. Dennis Hopkins, representing his clients, LGIO Partnership, Perot Investments Partners, Ltd. , H. Ross Perot, E-Systems Pool Trust, Tom E. Purvis III, Lisanne M. Purvis and Pamela R. Ross for annexation of approximately 5,169.79 acres of land, which includes the pro- posed airport site. This annexation request is now being processed and is sch- eduled for public hearing by the Fort Worth City Plan Commission on April 29, 1987.
