Home My WebLink AboutContract 21489 ® ® ® ® e RENEWAL AMENDMENT CITY SECRETA CONTRACT NO The AT&T Commission Agreement entered into as of July . 16, 199_4 ("Agreement"), between AT&T Communications, Inc. acting on behalf of the Interstate Division of AT&T Corp. and the AT&T Communications interexchange companies ("AT&T") and City of Fort Worth ("Agent") is amended, effective upon signing by both parties, as follows: 1. The phrase "AT&T Non-Sent Paid Calls" as it appears throughout the Agreement shall be amended to read as "AT&T undesignated Non-Sent Paid Calls". 2. The phrase "AT&T Revenues" or "AT&T Non-Sent Paid Revenues" as it appears throughout the Agreement shall be amended to read "Revenue from AT&T undesignated Non-Sent Paid Calls". July 16, 19950 3. The term of the Agreement is extended for a period of one Lj_) year(s) from Lq xmLK . The Agreement shall be automatically renewed for additional one-year terms unless either party gives thirty (30) days written notice of its intention not to renew. 4. Any rate change will be effective beginning on the 16th day of the first calendar month of the renewal period. 5. DETERMINATION OF REVENUE FROM AT&T UNDESIGNATED NON-SENT PAID CALLS For Locations where AT&T does not track revenue from LEC public telephones, revenue from AT&T undesignated Non-Sent Paid Calls will be estimated as follows: a. If 25% or more of the LEC public telephones at the Location(s) listed in Attachment A are in trackable areas, AT&T will develop a monthly average revenue (MAR) for AT&T undesignated Non-Sent Paid Calls from such phones. The MAR will be multiplied by the number of Agent's LEC public telephones in non-trackable areas in calculating Agent's monthly revenue from AT&T undesignated Non-Sent Paid Calls. b. If fewer than 25% of the LEC public telephones at the Location(s) listed in Attachment A are in trackable areas, AT&T will determine a MAR per LEC public telephone based on a market average. This figure shall then be multiplied by the number of Agent's LEC public telephones in non-trackable areas in calculating Agent's monthly revenue from AT&T undesignated Non-Sent Paid Calls. FOR LONG DISTANCE TELEPHONE SERVICE FOR COIN PHONES LOCATED ON CITY PROPERTY RECOMMENDATION: It is recommended that the City Council authorize the City Manager to amend City Secretary Contract No. C-14513 in order to extend the term of the agreement with AT&T Communications, Inc. for operator assisted ("0 Plus") long distance service for coin telephones located on City property to July 1'5, 1996, and to revise the commission schedule with an option for the City to renew the agreement for additional terms of one year. DISCUSSION: This agreement will generate an estimated revenue to the City of $15,000 from commissions paid by AT&T. The term of the agreement will be July 17, 1995 to July 18, 1996 with the option to renew for additional one-year terms. There are 157 coin telephones owned by Southwestern Bell Telephone Company installed in City facilities for use by the public. Long distance telephone service to these phones in this, and previous years, has been provided by AT&T, for which it pays the City a sliding commission as described below: Monthly Commission Rate (%) Monthly AT&T Revenue 22 0 - $2,083.33 24 $2,083.34 - $6,249.99 26 $6,250.00 + The monthly commission rate is based on a percentage of the total revenues received from operator assisted ("0 Plus," collect, credit card and billed to third number) calls. In the previous year, the commission was a flat rate of 22%.
