HomeMy WebLinkAboutContract 52804-A4City Secretary Contract No. 52804-A4 STATE OF TEXAS § COUNTY OF TARRANT § KNOWN ALL BY THESE PRESENTS: FOURTH AMENDMENT TO CITY SECRETARY CONTRACT NO. 52804 THIS FOURTH AMENDMENT to City Secretary Contract No. 52804 is entered into by and between the City of Fort Worth ("City"), a home -rule municipality of the State of Texas, acting through Valerie Washington, its duly authorized Assistant City Manager, and Tradebe Environmental Services, LLC ("Contractor"), acting through Curtis Russell, its Director of Proposals Management. WHEREAS, the City and Contractor have entered into that certain agreement identified as City Secretary Contract No. 52804 (the "Contract") commencing on September 18, 2019 for the transportation, packaging, and disposal of hazardous, special, and solid waste, as authorized on August 20, 2019 by Mayor and Council Communication 19-0054; and WHEREAS, the Contract is exempt from the prow 1 s 1 ons of Chapter 252 of the Texas Local Government Code under the general exemption provided for procurements necessary to preserve or protect the public health or safety of a municipality's residents; and WHEREAS, the parties wish to extend the term of the Contract for a final renewal term commencing on September 18, 2023 and ending September 17, 2024, and sufficient funds have been appropriated; and WHEREAS, the parties also wish to revise the Contract's not -to -exceed amount from One Hundred Fifty Thousand Dollars ($150,000.00) to One Hundred Eighty -Seven Thousand Five Hundred Dollars ($187,500.00); and WHEREAS, the parties agree that all other terms and conditions shall remain the same as stated in City Secretary Contract No. 52804, as amended; NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: Extended Term of Contract. City Secretary Contract No. 52804, as amended, is extended to include a renewal term beginning September 18, 2023 and ending September 17, 2024. 2. Compensation. City Secretary Contract No. 52804 is amended to provide that the total, not -to -exceed amount of compensation shall not exceed One Hundred Eighty -Seven Thousand Five Hundred Dollars and 00/100 ($187,500.00), billable according to the revised Fee Schedule and subject to all other terms and conditions as stated in City Secretary Contract No. 52804, and subject to prior duly authorized and executed amendments. Miscellaneous. All other definitions, terms, and conditions of City Secretary Contract No. 52804, as amended, shall remain unchanged except as expressly set forth herein.
