FIRST AMENDMENT TO CITY CONTRACT NO.
SECRETARY CONTRACT NO. 24130
Whereas, on the 10th day of August, 1998, the City of Fort Worth and the
Blue Raider Athletic Association, Inc. entered into a License Agreement, same
being City of Fort Worth City Secretary Contract No. 24130, whereby Blue Raider
Athletic Association, Inc. was granted the use of certain real property owned by
the City of Fort Worth and referred to in said contract as the "demised premises";
and
Whereas, the City of Fort Worth and Blue Raider Athletic Association, Inc.
desire to amend the License Agreement to provide for the installation by the City
of Fort Worth of water and sewer service lines and the obligation for payment for
such lines being assumed by the Blue raider Athletic Association, Inc.
NOW THEREFORE,
The City of Fort Worth, a home-rule municipal corporation located in
Tarrant and Denton Counties, hereinafter referred to as "City", and the Blue
Raider Athletic Association, Inc., hereinafter referred to as "Licensee", do hereby
agree as follows:

City of Fort Worth City Secretary Contract No. 24130 is hereby amended
by adding paragraph 43, which shall be and read as follows:
43.
43.1 Licensee has requested that City install water and
wastewater service lines to serve the demised premises. City
agrees, at the sole cost and expense of Licensee, to install or
cause to be installed the water and wastewater service lines.
43.2 Licensee agrees, upon completion of the water and
wastewater service lines, to establish a service account in its name
and be responsible for the monthly service costs associated with
the provision of water and sewer service to the demised premises.
43.2 The parties hereto agree that the cost to install the water and
wastewater service lines is $12,235.70. Licensee agrees to pay to
City the cost of such installation over a period of sixty (60) months,
plus simple interest at the rate of 9% percent per annum. The first
payment in the amount of $236.55 shall be due upon the execution
of this amendment. Subsequent payments in the same amount

shall be submitted to City with Licensee's payments for water and
wastewater service to the demised premises.
43.3 Failure to make any payment required under this paragraph
shall be a material breach of this License Agreement, entitling City
to terminate the agreement for cause.

All other terms, provisions and conditions of City of Fort Worth City
Secretary Contract No. 24130 not amended hereby continue in full force
and effect.

SUBJECT AMENDMENT NO. 1 TO THE LICENSE AGREEMENT WITH THE BLUE RAIDER
ATHLETIC ASSOCIATION, INC. TO OPERATE A PUBLIC RECREATION FACILITY
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to the
license agreement (City Secretary Contract No. 24130) with the Blue Raider Athletic Association, Inc. to
allow for the extension of water and wastewater service lines at a cost of$12,235.70.
DISCUSSION:
On May 19, 1998 (M&C C-16787), the City Council authorized the execution of a license agreement
with the Blue Raider Athletic Association, Inc. (Association) to operate a public recreation facility for a
contract period of 10 years, ending August 31, 2010. The property is owned by the City.
Under this amendment, the Water Department will extend public water and wastewater service lines in
order to provide services to the Association's facilities at 4320 Alta Mesa Boulevard. The total project
cost to be borne by the Association is $12,235.70. The Association will reimburse the City in equal
monthly payments of $236.55 at a simple interest rate of 9% per annum over a term of 5 years. Billing
will be combined with the monthly water and wastewater bill to the Association.
This project is located in COUNCIL DISTRICT 6.
FISCAL INFORMATION/CERTIFICATION:
The Customer Service Division of the Water Department will be responsible for the collection of all fees
associated with this amendment.
