AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 53807
WHEREAS, the City of Fort Worth (CITY) and Burgess & Niple, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 53807, (the
CONTRACT) which was authorized by M&C 20-0176 on the 7tn day of April,
2020 in the amount of $ 322,000.00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Water and Sanitary Sewer Replacement Contract 2019, WSM-G; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $25,287.00 (Water).
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $347,287.00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

This letter is our formal request for a Scope of Work Revision for engineering services.
Justification
The City has requested that Burgess & Niple (B&N) provide additional engineering services beyond the
original scope of work. These services are identified below as four separate tasks.
Task 101.0 Southside Water CO Packaae
The current B&N southside water line design is affected by easement acquisition issues, which necessitate
shifting the water line design into TxDOT right-of-way. B&N is to meet and coordinate with TxDOT and
revise the southside water lines in a manner that is acceptable to TxDOT and the City. B&N will provide
separate 90% complete plans and Final 100% complete plans for water improvements south of Jacksboro
Highway.
The lump sum fee for Task 101.0 is $3,028.00.
Task 102.0 Construction Phase Services
B&N shall provide increased construction phases services through additional coordination with TxDOT than
was anticipated in the original scope of work. B&N will respond to TxDOT questions regarding the
Southside Water CO Package and will provide record drawings at the conclusion of construction activities.
The lump sum fee for Task 102.0 is $1,390.00.
Task 201.0 Love Circle Fire Hvdrant Relocation
B&N will add additional water improvements along Love Circle, to the current City Project referenced above
and constructed in the current City Misc. Construction Contract. The fire hydrant currently in conflict with
proposed TxDOT construction will be relocated to an appropriate location per conversations with TOOT at
coordination meetings held at 10:30 AM on 10/19/22 and 9:00 AM on 6/28/23. B&N will design the
relocation of the fire hydrant at the end of Love Circle including a 6" tee, gate valve, and 6" water line to not

conflict with future ongoing TxDOT construction along Love Circle while still allowing for adequate flushing
by City Staff. The plan sheet will be a stand-alone plan set for the City's usage in the Fort Worth Water
Department's Misc. Contract. B&N will coordinate with TxDOT and the City and will provide a Final 100%
plan sheet of this design.
The lump sum fee for Task 201.0 is $1,145.00.
Task 301.0 Northside Bid Package
Due to changes to Culvert B by TxDOT, which affect the current B&N northside water line designs, B&N is
to meet and coordinate with TxDOT and revise the northside water lines in a manner that is acceptable to
TxDOT and the City. B&N will provide new 90% complete plans and Final 100% complete plans and
specifications. These plans will also include the southside sanitary sewer that is not included in the
Southside Water CO Package.
The lump sum fee for Task 301.0 is $19,724.00.
Based upon this revised scope of work, the additional design cost proposed for Amendment No. 1 is
$25,287.00. See the attached Level of Effort spreadsheet.
