SECOND AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NO. 58674, A NON-EXCLUSIVE GROUNDS MAINTENANCE SERVICES
AGREEMENT FOR IRRIGATION SERVICE BETWEEN THE CITY OF FORT
WORTH AND LAWN PATROL SERVICE, INC.
This SECOND AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NUMBER 58674 ("Second Amendment and First Renewal") is made and entered
into by and between the CITY OF FORT WORTH ("City"), a home -rule municipal
corporation of the State of Texas, acting by and through its duly authorized Assistant City
Manager, and LAWN PATROL SERVICE, INC. ("Contractor"), a Texas corporation, acting
by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive grounds maintenance
services agreement, City Secretary Contract Number 58674 ("Agreement");
WHEREAS, the Agreement provides for a primary term of one year, with five (5)
subsequent one-year renewal options;
WHEREAS, the primary term expires on September 30, 2023;
WHEREAS, the City and Contractor exercised a First Amendment, the same being CSC
No. 58674-A1; the Amendment to the Agreement adjusted the expiration date on the original
contract to September 30, 2023 in order to match the M&C terms;
WHEREAS, the parties desire to exercise the first one-year renewal term, effective
beginning on October 1, 2023 and ending on September 30, 2024;
WHEREAS, Contractor requested a unit price increase of 3.0% for work that it performs
at certain locations throughout the City; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for one additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the first renewal
term, effective beginning on October 1, 2023 and ending on September 30, 2024 ("Second
Amendment and First Renewal").
II.
All unit prices in Exhibit B of the Agreement, including any previous On -Call
amendments if applicable, pertaining to grounds maintenance are hereby amended to increase the
pricing by 3.0% for all locations set forth in ITB/RFP No. 22-0213.

1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this Second Amendment and First Renewal.
2. All terms of this Second Amendment and First Renewal that are capitalized but
not defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this Second
Amendment and First Renewal to be effective on October 1, 2023.
