HomeMy WebLinkAboutContract 27613-A1 AMENDMENT NO. 1 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.a-1l,13-A 1 (M&C Required) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Black and Veatch Corporation, (Engineer) made and entered into City Secretary Contract No. 27613, (the Contract) which was authorized by the City Council by M&C 19040 on the 9th day of April 2002; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LXI (61) . WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in M&C C-23953, adopted by the City Council on the 12th day of December 2009, and further amplified in a proposal letter dated September 29, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $183,875.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $360,515.00. Authorize the transfer of$194,875.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$194,875.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 1 in the amount of$183,875.00 to City Secretary Contract No. 27613 with Black and Veatch Corporation for Sanitary Sewer Rehabilitation Contract LXI, thereby increasing the contract amount to $360,515.00. DISCUSSION: On April 9, 2002, (M&C C-19040) the City Council authorized the City Manager to execute an Engineering Agreement in the amount of$176,640.00 with Black and Veatch Corporation for Sanitary Sewer Rehabilitation Contract LXI (61). Additional design services for the replacement of the deteriorated sanitary sewer lines located on Adams Street (Jacksboro Highway to 23rd Street), True Avenue (Flagstone Drive to 23rd Street), Alleyway between Azle Avenue and Northwest 26th Street (Grayson Avenue to West Long Avenue). These sanitary sewer lines were not included in the original contract; Updating the plans and specifications to reflect current City standards; Design for sewer service relocation; Additional survey and easement preparation; Traffic control plan preparation; and Additional route studies for M-142, M-144, M-145 and L-4964 as requested by the City. Black and Veatch Corporation proposes to perform the additional design work for a lump sum fee of $183,875.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. Black and Veatch Corporation is in compliance with the City's M/WBE Ordinance by committing to 26 percent M/WBE participation on this Amendment No. 1. The City's goal on this amendment is 15 percent. In addition to the contract amount, $11,000.00 is required for project management, real property acquisition and utility coordination. Engineering Manager, City of Fort Worth 1000 Throckmorton Street Fort Worth, Texas 76102 Subject: City Contract#27613, Amendment No. 1 Request Dear Mr. Sholola: The Contract 61 project has changed and increased in scope at the request of the Water Department to address "Unanticipated Conditions and Deficiencies" in existing sewer routes. We respectfully request an amendment to the original Agreement to provide adjustments as follows: • Adjust Scope of Work • Adjust Project Schedule • Increase Cost by$183,875.00 ($207,529.00 minus $23,654.00 remaining in the existing contract) Additional and Revised Scope changes: • Route Studies to address unanticipated conditions and deficiencies. • Abandonment& rerouting of sewers &services lines and additional sewers. • Added surveys, easements, and rights of entry. • The single construction contract was divided into two, requiring additional coordination, reproduction, and bidding &construction phase assistance. • The project was suspended in 2003 and requires reestablishing control points and confirmation of topography and updating ownership data. • Traffic Control Plans are added to the scope of work. SCOPE CHANGES The following Project Scope Changes are required. A. Route Study. The original Concept Plan was submitted to the City of Fort Worth on May 29, 2002 and a new route study is required for M-145, L-2365, M-142R, L-2326. Also L-2056"A"was added to the project with a request to examine the possibilities of relocating the sewer to street right-of-way. Monthly Consultant Project Status Review Meeting. Meetings will start upon notice to proceed and continue for about 9 months. Including preparation of reports, and the 2-hour meeting, each meeting will require 4 hours of work. C. Service Lateral Design The additional sewer re-routes will require relocating sanitary sewer service laterals. Service lines for 31 homes located on Hanna, Fielder, Standifer and Roosevelt will be relocated from the back to the street. The services for 14 mobile homes and approximately 12 homes will be relocated when the sanitary sewer line is moved from the side yard to the street. (A total of 57 services will be relocated.) D. Design -Sewers The scope and effort for sewer designs increases as a result of: 1. Additional new sewer length (2,311 feet) 2. Prepare alignment and new easement plans for realignments 3. Coordinate of additional surveying 4. Update base maps based on surveying and visuals 5. Professional engineer to collect new information, check designs and revise for conflicts, update and seal designs of 19,651 feet of sewers and 57 new service laterals (Total of 51 sheets.) E. Additional Surveying, Easements, Control, & Ownership Data Additional surveying is required as follows: 4,502 feet F. Traff ic Control. Traffic Control Plans are required for Part 2 (this amendment) and would be prepared by a subconsultant. Plans will include detours, closures, and accommodations for driveways. G. Reproduction Increase. Reproduction will include an additional 67 sets of plans, 1 set of mylar plans and 50 sets of specification. Some documents used on each of the two projects (Part 1 and Part 2)will be duplicated. H. Pre-Construction Assistance. There will be two pre-construction conferences. One pre-construction conference is included in the original contract. This amendment request includes additional effort for the second pre-construction conference equal to 4 hrs. I. Public Meeting. There will be one public meeting and preparation of an exhibit.
