REASONS FOR CHANGE ORDER The Contractor requested additional compensation from the Developer to install the sidewalks and backfili behind the curbs, The contracor also requested 8
weeks to be added to the contract time. To expedite the construction, the Developer obtained a different sub -contractor Io install the items at the contract price
and within the original contract time.
NO CITY FUNDS INVOLVED IN THIS CONTRACT. DEVELOPER IS RESPONSIBLE FOR 100% OF THE CHANGE ORDER COST AND NO
REIMBURSEMENT FROM THE CITY WILL BE SOUGHT BY THE DEVELOPER.

To Whom It May Concern:
On August 10, 2023 a final inspection was made on the subject project. There were punch list items
identified at that time. The punch list items were completed on August 22, 2023. The final inspection
and the corrected punch list items indicate that the work meets the City of Fort Worth specifications and
is therefore accepted by the City. The warranty period will start on August 22, 2023, which is the date of
the punch list completion and will extend of two (2) years in accordance with the Contract Documents.

"CONTRACT")."
3. "All bills for labor, material, utilities, insurance and all other accounts in connection with or
arising from the above CONTRACT have been paid and satisfied. Upon the request of the City
of Mesquite, I will allow a complete examination of the financial records relative to this project,
including canceled checks, invoices and statements."
4. "CONTRACTOR HAS FULLY SATISFIED AND PAID ANY AND ALL CLAIMS in
accordance with applicable statues, ordinances, charters and other provisions."
5 _ "CONTRACTOR will accept FULL AND FINAL PAYMENT under the aforementioned
CONTRACT and waives and releases any right the CONTRACTOR may have to pursue claims
of any nature against the City of Mesquite arising out of or in any manner in connection with the
above stated CONTRACT, including but not limited to claims for damages suffered by third
parties or the CONTRACTOR due to any cause or recovery of liquidated damages suffered by
third parties or the CONTRACTOR due to any cause or recovery of liquidated damages which
may have been withheld by the City of Mesquite. This Affidavit shall not be deemed to after or
modify the terms and provisions of the above -stated CONTRACT."
