HomeMy WebLinkAboutContract 54172-A3AMENDMENT NO. 3 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES FORT WORTH POLICE DEPARTMENT — SOUTH PATROL DIVISION STATE OF TEXAS COUNTY OF TARRANT CITY SECRETARY CONTRACT NO. 54172-A3 WHEREAS, The City of Fort Worth and Callahan & Freeman Architects (Consultant) made and entered into City Secretary Contract No. 54172 (The Contract) which was administratively authorized the 20th day of July, 2020, for Fort Worth Police Department's South Patrol Division; and Amendment No. 1 was approved by M&C 20- 0549 in the amount of $262,600.00 for completion of Construction Drawings and Construction Phase Service; and Amendment No. 2 was administratively approved in the amount of $78,290.00 for additional services for an Oncor utility easement, and construction administration services for extended construction schedule, value engineering service, and structural redesign coordination of this project. WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional services necessary for a second Oncor utility easement. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional professional services associated with the design and construction administration of this project. The total cost of these additional services is $1,400.00 plus $0.00 in reimbursable expenses. The scope of services is described more fully in Attachment "E". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "E". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "E". However, the total fee paid by the City shall not exceed a total of $427,290.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." This easement is required to accommodate power poles that had to be located closer to the property line to allow space for the future City sidewalk. Below is the fee requested. Boundary Survey and Easement Exhibit (BHB) $1,200 Project Management $200 Total Additional Services Fee $1,400 It is our understanding that the City will prepare a contract amendment to add this service scope and fee. Please let us know if anything is needed from us to support that process. Upon receipt of approval and a notice to proceed with this work, we will engage BHB to prepare the easement documentation. Stake East property line — BHB will stake the east property line from the intersection of West Risinger Road and McCart Avenue. Topographic Survey — BHB will locate the south drive entrance along McCart Avenue located at the southeast corner of the property. Easement — BHB will perform a boundary survey for the creation of 1 easement exhibit, the easement will be situated within Lot 1, Bloc 1, South Patrol Addition in order to establish property boundary. BHB will create Exhibits "A" (Metes and Bounds Description) and Exhibits "B" (drawing showing easement) for inclusion in the easement dedication document (to be prepared by Oncor Electric Delivery Company). The drawings will be prepared at a suitable scale for viewing. Deliverables will be a signed, sealed .pdf. The GENERAL CONDITIONS attached hereto is made a part of this Agreement. In consideration for the scope described above we propose a stipulated sum: Staking, Topographic Survey and 1 Easement Exhibit — One Thousand Two Hundred Dollars and no cents ($1,200.00) plus sales tax Invoices will be forwarded to your office based upon the percentage completed during each billing period and will be due upon receipt of each invoice. Stipulated sum includes cost of long-distance telephone calls, telephone faxes and mailing costs. Stipulated sum [includes travel expenses for travel to the project site, but] does not include reproduction expenses, other than single copy originals for final drawings.
