HomeMy WebLinkAboutContract 58755-A1Date Received: 10/06/2023 Time Received: 10:00 am City Secretary Contract Number: 58755-A1 FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58755 A COMMUNITY FACILITIES AGREEMENT BETWEEN THE CITY OF FORT WORTH AND VELOCIS MERCANTILE JV, LP This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58755 ("First Amendment") is made and entered into by and between the City of Fort Worth ("City"), a home -rule municipal corporation of the State of Texas, and Velocis Mercantile JV, LP ("Developer"), a Delaware limited partnership. WHEREAS, the City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure improvements for a Project known as Mercantile Beach, City Secretary Contract Number 58755 ("CFA"); and WHEREAS, the construction plans submitted to the City for the Project failed to identify two locations where private storm drain lines cross over existing public sanitary mains, and one location where a private storm drain line crosses under an existing public sanitary main; and WHEREAS, the City desires to protect the existing public sanitary mains from the potential adverse impact caused by the installation of the new private storm drain lines by incorporating details of the crossing locations in the construction plans, requiring concrete encasement of the existing sanitary sewer lines, and requiring CCTV of the pre-existing conditions and post -construction conditions at the locations of the crossings to ensure that the public sanitary mains are not impacted by the new private storm lines; and WHEREAS, the Developer has revised the construction plans to show the crossing; and WHEREAS, Change Order Number 1 has been executed to reflect the increased scope of work; NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends City Secretary Contract No. 58755 as follows: 1. The CFA is amended to add Exhibit D which shall be and read as set forth in Attachment 1 of this First Amendment, which is attached hereto and incorporated herein by reference. The CFA is amended to add section 37 to be and read as follows: 37. Private Storm Drain Crossings The construction plans submitted to the City for the Project failed to identify two locations where private storm drain lines cross over existing public sanitary mains, and one location where a private storm drain line crosses under an existing public sanitary main. Developer shall protect the existing public sanitary mains from the potential adverse impact caused by the installation of the new private storm drain lines by incorporating details of the crossing locations in the construction plans, installing concrete encasement over the existing sanitary sewer lines, and performing CCTV of the pre-existing conditions and post -construction conditions at the locations of the crossings to ensure that the public sanitary mains are not impacted by the new private storm lines. Developer has revised the construction plans to show the crossings and executed Change Order Number 1 to the Project to reflect the increased scope of work as more specifically set forth in Exhibit D, which is attached hereto and incorporated herein by reference. If the existing public sanitary sewer mains are damaged as a result of the construction of the private storm drain lines by Developer's contractors, or any other construction by Developer's contractors, including damage discovered as a result of the post -construction CCTV, Developer shall repair the damage to the public sanitary sewer mains per the City's standard specifications at Developer's sole cost and expense before the City will accept the Improvements being constructed pursuant to this Agreement, and the City's acceptance of the repairs shall not be unreasonably withheld. Additionally, Developer shall be responsible for the total cost incurred by the City if an emergency response is required for bypass pumping or cleaning due to Developer's contractors' work around the existing Vitrified Clay (VC) sewer lines. The City of Fort Worth Water Department's Field Operations Division's report on the pre -construction CCTV results are attached hereto as Exhibit D. 3. a. All other provisions of City Secretary Contract Number 58755 which are not expressly amended herein, shall remain in full force and effect. b. All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in City Secretary Contract Number 58755.
