RECITALS
A. City ofFort Worth,Texas(the'^City')and Assignor entered into that certain
Community Facilities Agreement approved by the City Council of the City (the "City
Cound|'')ou July 29.2003uo City Council Policy No.%32.
B. Assignor now desires to assign all of Assignor's right,title and interest in and
»m the Agreement mAssignee.
NOW,THEREFORE,in consideration of the foregoing premises,the sum of Ten and
Nu/100 Dn/|us ($10,00) and other good and valuable coosidcounu, the receipt and
sufficiency of which are hereby acknowledged,the parties agree as follows:
AGREEMENTS
l. Assignor hereby assigns to Assignee all of Assignor's right,title and interest
in and N the Agreement.
2. Assignee hereby accepts such truou1ez of Assignor's tights in and to the
Agreement and hereby irrevocably and unconditionally assumes all duties and obligations of
Assignor under the Agreement accruing on or after the date hereof,upon the sarne terms and
conditions as set out in the Agreement,including the obligation to comply with the Policy.
3. Unless otherwise defined herein,all capitalized terms shall have the meanings
ascribed m them in the Agreement.
4. This Assignment may bc executed in multiple counterparts which when taken
together shall bo considered one and the same document.
