COUNTY OF TARRANT $
WHEREAS, the City of Fort Worth (City) and Pate Engineers, Inc.
(Engineer) made and entered into City Secretary Contract No. 29041,
(the Contract) which was authorized by the City Council by M&C C-19719
on the 19th day of August, 2003 and subsequently revised by one
amendment; and
WHEREAS, the Contract involves engineering services for the
following project:
Water and Sanitary Sewer Replacement Contract 2003 STM-E
WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated November 19,
2004, a copy of which is attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by
Engineer total $21,000.00.

Article II of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall not exceed the sum of
$174,376.74.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Conlon:
We would like to request that an amendment be granted for the above referenced project
in the amount of$21,000.00. This request is based on the final instructions we received
in a meeting with you and Mr. Tony Sholoa yesterday in your office. This amendment is
the cost to provide the surveying and engineering design of a requested extension to the
36-inch water line in Beach Street. The extension consists of adding 300+ feet of line
along Avenue B and tying the line into the existing water pump station on this street.
This also covers the cost to design an 8" parallel main to serve two block that currently
has inadequate service. This sum also covers the cost to redesign the requested 24"tie-in
at Mitchell Street. The amendment would include $1,000.00 to one of our M/WBE
subcontractors for additional surveying services. We have already authorized ANA
Consultants to begin gathering the additional field information needed. We have already
begun making the requested changes to our plans to expedite the bidding of these plans,
because we understand that the City needs to bid these proposed improvements as soon as
possible. The other M/WBE subcontractor should not be affected and the specified
amount for their portion of our contract does not need to change. The amendment costs
break out as follows:
Pate Engineers, Inc.: Project Manager- $ 2,080.00
Project Engineer- 5,395.00
CARD Designer- 8,950.00
CARD Technician- 3,145.00
Administrative Asst. - 430.00
Pate Total $20,000.00
M/WBE (see attached ANA document) $ 1,000.00

As mentioned above, we have begun to make known changes to the plans and have the
surveyor busy collecting necessary field information. We would like to receive approval
of this amendment request as soon as possible since we have already completed most of
the needed additions and changes on this project. We are planning to meet or beat your
requested deadline for this work. Please call me with any questions concerning the
