HomeMy WebLinkAboutContract 56273-A1AMENDMENT NO. 1 TO AGREEMENT STANDARD AGREEMENT FOR TECHNICAL SERVICES SOUTH PATROL DIVISION STATE OF TEXAS CITY SECRETARY CONTRACT NO. 56273-A1 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Alliance Geotechnical Group, Inc. (Consultant) made and entered into City Secretary Contract No. 56273 (The Contract) which was administratively authorized by the City Council, the 3rd day of September, 2021, for Fort Worth Police Department, South Patrol Division — New Facility, Construction Materials Testing and Inspection Service; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the geotechnical material testing & inspections services agreement for additional material testing & inspections services for site amenities — sidewalks, flatwork, and pre-cast fence concrete piers. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I— Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional testing & inspection services in conjunction with the construction of site amenities. The not-to-exceed cost of this additional service is $24,767.87 plus $0.00 in reimbursable expenses. The scope of services is described more fully in Alliance Geotechnical Group's letter dated October 10t" 2023, subject: "Change Order for Construction Materials Testing Services, FWPD South Patrol Division, AGG Project No.: FC22-395, Fort Worth, Texas". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "B". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "B". However, the total fee paid by the City shall not exceed a total of $99,000.00 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." REASON FOR CHANGE Based on our understanding of current project conditions, additional testing and inspections will be required. . Based on original project schedule, the majority of the construction materials testing work should have been completed by now other than some miscellaneous items. . Longer duration to completion for various major portions of the project. REMAINING WORK TO BE TESTED (According to CORE Construction) • Sidewalks & Flatwork (4 days) • Pre-Cast Screen Wall Piers and Concrete Pours (5 days) COMPENSATION While testing is dependent on the construction sequence, contractor performance and efficiency, weather conditions, and the actual testing performed, we suggest an estimated budget increase of Not to Exceed $24,767.87 for a total budget of $99,000.00. The invoicing for this project will use the attached Fee Schedule and the actual quantity of work performed. City of Fort Worth Property Management Department and Alliance Geotechnical Group may subsequently agree in writing to provide for additional services to be rendered under this agreement for additional, negotiated compensation. Services provided by Alliance will be consistent with the engineering standards prevailing at the time and in the area that the work is performed; no other warranty, express or implied, is intended. Please indicate your approval of the proposal and the Alliance Geotechnical Group's General Conditions by signing below acceptance form and returning.
