AMENDMENT NO. I AND RENEWAL NO.3
TO
CITY OF FORT WORTH CONTRACT 54003
This Amendment and Renewal is entered into by and between the City of Fort Worth
("City") and Forterra Pipe and Precast LLC ("Contractor"), City and Contractor may be
referred to individually as a Party and collectively as the Parties.
WHEREAS, on March 10, 2020 the Parties entered into City Secretary Contract 54003
to provide reinforced concrete pipe ("Contract"); and
WHEREAS, the Contract was most recently renewed on November 1, 2021 and City
wishes to renew the Agreement for its Third Renewal Term, beginning on November 1, 2022 and
expiring on October 31, 2023; and
WHEREAS, the Parties wish to amend the Contract, as renewed, to increase costs for
certain services within the contract amount.
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:
1.
RENEWAL
The parties agree to renew the term of the Agreement for an additional one year -term beginning
November 1, 2022 and expiring October 31, 2023, unless terminated earlier in accordance with
the terms of the Agreement.
2.
AMENDMENT
The price schedule attached to the original Contract is hereby replaced by the price schedule
attached hereto and incorporated herein, to be effective beginning with the second renewal of the
contract.
3.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.
