FIRST AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY CONTRACT
NO. 58958, A NON-EXCLUSIVE MOWING AND GROUNDS MAINTENANCE
SERVICES AGREEMENT FOR SOUTH AND WEST DISTRICT CITY FACILITIES
AND PARKS BETWEEN THE CITY OF FORT WORTH AND SCOTT LANDSCAPE
MAINTENANCE, INC.
This FIRST AMENDMENT AND FIRST RENEWAL OF CITY SECRETARY
CONTRACT NUMBER 58958 ("First Amendment and First Renewal") is made and entered
into by and between the CITY OF FORT WORTH ("City"), a home -rule municipal corporation
of the State of Texas, acting by and through its duly authorized Assistant City Manager, and
SCOTT LANDSCAPE MAINTENANCE, INC. ("Contractor"), a Texas corporation, acting by
and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract ("CSC")
Number 58958 ("Agreement");
WHEREAS, the primary term of the Agreement expires on November 30, 2023 and
includes four (5) one-year renewal options;
WHEREAS, Contractor requested a unit price increase of 4.0% for work that it performs
at certain locations throughout the City;
WHEREAS, the parties also desire to amend portions of Exhibit B concerning the pricing
schedule for certain locations;
WHEREAS, the Agreement provides for on -call mowing services on either an individual
or recurring basis at pricing equivalent to comparable;
WHEREAS, the parties desire to exercise the first one-year renewal term, effective
beginning on December 1, 2023 and ending on November 30, 2024; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the Agreement
for one additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the First Renewal
term of one year, effective beginning on December 1, 2023 and ending on November 30, 2024.

II.
Exhibit B of the Agreement is hereby amended to revise the pricing schedule for the
specific locations set forth below. All other locations in Exhibit B remain unaffected by this First
Amendment and First Renewal.

All unit prices in Exhibit B of the Agreement, including any previous On -Call amendments
if applicable, pertaining to grounds maintenance are hereby amended to increase the pricing by
4.0% for all locations set forth in ITB/RFP No. 22-0208.
IV.
Contractor will provide on -call mowing services in accordance with the terms of this
Agreement and Exhibit B-1, which is attached hereto and incorporated herein for all purposes.
All provisions related to on -call mowing in the Agreement, including, but not limited to, the non -
exclusivity of the on -call mowing projects, remain in full force and effect.
V.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this First Amendment and First Renewal.
2. All terms of this First Amendment and First Renewal that are capitalized but not
defined have the meanings assigned to them in the Agreement.
