SECOND AMENDMENT AND SECOND RENEWAL OF CITY SECRETARY
CONTRACT NO. 57426, A NON-EXCLUSIVE MOW NG AND GROUNDS
MAINTENANCE SERVICES AGREEMENT FOR PANTHER ISLAND AND RACE
STREET CORRIDORS BETWEEN THE CITY OF FORT W TH AND LAWN
PATROL SERVICE, INC.
This SECOND AMENDMENT AND SECOND RENEWAL OF CITY
SECRETARY CONTRACT NUMBER 57426 ("Second Amendment and Second Renewal")
is made and entered into by and between the CITY OF FORT W TH ("City"), a home -rule
municipal corporation of the State of Texas, acting by and through its duly authorized Assistant
City Manager, and LAWN PATROL SERVICE, INC. ("Contractor"), a Texas corporation,
acting by and through its duly authorized representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract Number
57426 ("Agreement");
WHEREAS, the primary term of the Agreement expired on November 30, 2022 and
includes four (4) one-year renewal options;
WHEREAS, the City and Contractor exercised the First Renewal Option and First
Amendment, which expires on November 30, 2023, the same being CSC No. 57426-R1A1; the
Amendment to the Agreement increased all line items by 2.0% and allowed for a 25.0% discount
on litter only services;
WHEREAS, the parties desire to exercise the second one-year renewal term, effective
beginning on December 1, 2023 and ending on November 30, 2024;
WHEREAS, the parties further desire to increase the aggregate amount of the
Agreement from $170,000.00 to 212,500.00;
WHEREAS, Contractor requested a unit price increase of 3.0% for work that it performs
at certain locations throughout the City; and
NOW, THEREFORE, the City and Contractor agree to renew and amend the
Agreement for one additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the Second
Renewal term of one year, effective beginning on December 1, 2023 and ending on November
30, 2024.

II.
All unit prices in Exhibit B of the Agreement, including any previous On -Call
amendments if applicable, pertaining to grounds maintenance are hereby amended to increase the
pricing by 3.0% for all locations set forth in ITB/RFP No. 22-0024.

Section 2.2, "SCOPE OF WORK", of the Agreement is revised to increase the aggregate
amount of the Agreement from $170,000.00 to $212,500.00 and is amended to read as follows:
"2.2 Contractor understands and agrees that the City will award non-exclusive
purchase agreements to multiple bidders for mowing and grounds maintenance services as
outlined in the Bid, which is on file with the City's Purchasing Department. Contractor further
understands that the aggregate not to exceed amount of all contracts awarded to multiple
contractors under the Bid will be in the amount of Two Hundred Twelve Thousand Five
Hundred Dollars and Zero Cents ($212,500.00), and the City makes no promise or guarantee
of the total amount of work that will be assigned to Contractor under this Agreement."
IV.
1. All other terms and conditions of the Agreement remain in full force and effect
except as specifically set forth in this Second Amendment and Second Renewal.
2. All terms of this Second Amendment and Second Renewal that are capitalized but
not defined have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this Second
Amendment and Second Renewal to be effective on December 1, 2023.
