FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58748
A COMMUNITY FACILITIES AGREEMENT BETWEEN
THE CITY OF FORT WORTH AND GCP VAN ZANDT, LLC
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 58748
(“First Amendment”) is made and entered into by and between the City of Fort Worth (“City”),
a home-rule municipal corporation of the state of Texas, and GCP Van Zandt, LLC
(“Developer”), a Nebraska limited liability company.
WHEREAS, the City and Developer entered into a Community Facilities Agreement for
the construction of public infrastructure Improvements for a Project known as The Van Zandt, City
Project Number 101488 (“CFA”); and
WHEREAS, Developer’s name was GCP III Van Zandt, LLC at the time the Secretary
Contract Number 58748 was executed, and the Developer’s name has recently been amended to
GCP Van Zandt, LLC on September 7, 2023; and
WHEREAS, Developer provided the City with a development bond as the financial
guarantee for the Improvements in the CFA; and
WHEREAS, Developer has hired a new contractor to construct the Improvements
pursuant to the CFA and added water improvements to the scope of work, and the estimated
construction costs have decreased from the previous contractor’s estimated costs; and
WHEREAS, the City and Developer desire to amend the CFA to reflect the revised Cost
Estimates and Cost Summary Table; and
WHEREAS, Developer has provided a bond rider to reflect the Developer’s name change
and reflect the additional water improvements;
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends City Secretary
Contract Number 58748:

Section 36 of the CFA is amended in its entirety to be and read as set forth in Exhibit A
of this First Amendment, which is attached hereto and incorporated herein by reference. The
revised Cost Summary Table reflects revisions made by Change Order 1.

The Cost Estimates in the CFA are amended in their entirety to be and read as set forth in
Exhibit B of this First Amendment, which is attached hereto and incorporated herein by reference.

a. All other provisions of City Secretary Contract No. 58748 which are not expressly
amended herein, shall remain in full force and effect.
b. All terms in this First Amendment that are capitalized, but not defined, shall have the
meanings ascribed to those terms in City Secretary Contract No. 58748.
