COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (CITY) and Wier & Associates, Inc. , (CONSULTANT) made and entered into City Secretary Contract No. 35265, (the CONTRACT) which was authorized by the City Council by M&C C-22077 on the 4th day of April, 2007 and amended by City Secretary Contract No. 36581 on the 28th day of January, 2008; WHEREAS, the Contract involves engineering services for the following project: Granbury Road from Altamesa Boulevard to a Station 1600 Feet South WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in the proposal letter dated January 14, 2009 (amended April 1, 2009) , a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by CONSULTANT total $41,725.00. 2. Article II of the Contract is amended to provide for an increase in the fee to be paid to CONSULTANT for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $81, 725. 00. 3 . An adjoining landowner requested that storm drain and sewer be made available with this project. This work was completed per your request. Therefore the total amount expended for all work in the scope of this change order is now $34,725. In addition, you requested that we allow $5,000 for construction administration activities. Additional direct costs in the amount of $2,000 are also required. We request an Amendment No. 2 to our current contract to reflect these changes to the scope and a revised fee of$41,725. RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the amount of$41,725.00 to City Secretary Contract No. 35265, an Engineering Services Agreement with Wier &Associates, Inc., thereby increasing the total fee to $81,725.00. DISCUSSION: The 2007 Critical Capital Program included funds for arterial streets, which included funding for the engineering and construction for the completion of Granbury Road/Summer Creek Drive as a four lane divided road from Dirks Road to Columbus Trail. On April 24, 2007, (M&C C-22077) the City Council authorized the City Manager to execute an Engineering Agreement with Wier &Associates, Inc., in the amount of$32,500.00 for the design of paving and drainage improvements to upgrade Granbury Road from Altamesa Boulevard to Appalachian Way to four lane divided arterial standards. The contract was previously revised by Amendment No. 1, approved administratively by the City Manager in the amount of$7,500.00 (City Secretary No. 36581, January 28, 2008) providing for a revised design necessitated by the realignment of a water line. Amendment No. 2 will provide for design modifications made necessary by unforeseen conditions in the field, further water line realignment, modifications requested by the City to the original design and previously excluded direct costs that should have been included. An M/WBE waiver has granted for this Amendment No. 2. This project is located in COUNCIL DISTRICT 6, Mapsco 102D and 102H. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the 2007 Critical Capital Projects Fund.
