FOURTH RENEWAL OF
FACILITIES AND COMMUNITY CENTER MEMBERSHIP AGREEMENT
(CSC 52681)
This FOURTH RENEWAL ("Fourth Renewal") is made and entered into by and between
the CITY OF FORT WORTH ("City"), a home -ruled municipal corporation of the State of
Texas, acting by and through its duly authorized Assistant City Manager, and TARLETON
STATE UNIVERSITY ("Tarleton"), a member of the Texas A&M University System, and
agency of the State of Texas. City and Tarleton are herein referred to individually as a ("Party")
and collectively as the ("Parties").
WHEREAS, on August 12, 2019 the Parties entered into a Facilities and Community
Center Membership Agreement to allow Tarleton students to obtain membership cards and utilize
the fitness rooms at certain Community Centers and the Haws Athletic Center, the same being City
Secretary Contract ("CSC") Number 52681 ("Agreement");
WHEREAS, the Agreement provides a primary term of one year and five (5) one-year
renewal terms to begin annually on August 121h (each a "Renewal Term");
WHEREAS, on September 29, 2020 the Parties exercised the First Renewal Term to be
effective on August 12, 2020 and expire on August 11, 2021;
WHEREAS, the Parties mutually acknowledge that the First Renewal Term expired on
August 11, 2021, and the Parties have continued to perform in accordance with the terms of this
Agreement;
WHEREAS, it is the collective desire of the Parties to extend this Agreement through the
Fourth Renewal Term; and
NOW, THEREFORE, in consideration of the mutual covenants and agreements
contained herein, the City and the Tarleton agree to renew and extend the Agreement as follows:
I.
The City and Tarleton hereby agree to renew and extend the Agreement for a one-year
period effective beginning August 12, 2023 and expiring August 11, 2024 ("Fourth Renewal
Term").
II.
(1) All terms and conditions of the Agreement that are not expressly amended pursuant
to this Fourth Renewal and shall remain in full force and effect.
(2) All terms in this Fourth Renewal that are capitalized but not defined shall have the
meanings assigned to them in the Agreement.
