HomeMy WebLinkAboutContract 43013-A1 CITY SEMARY AMENDMENT No. 1 CONTRACT No. TO CITY SECRETARY CONTRACT No. WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 43013 , (the CONTRACT) which was authorized by M&C C-25508 on the 20th day of March, 2012 in the amount of $ $1, 598, 450 . 00 ; and WHEREAS, the CONTRACT involves engineering services for the following project : East Rosedale Street Improvements from US 287 to Miller Ave, Project No. 00142 ; WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 16, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $44, 200. 00. (See Attached Funding Breakdown Sheet, Attachment B) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1, 642, 650. 00. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect . EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Access Energy provided asbui|t plans to Freese and Nichols on May 11, 2012. The gas line was shown in the asbui|ts10 be GD' below road surface; the bridge was designed to have drill shafts 50' below road surface and estimated S-G feet away horizontally. Freese and Nichols designed the bridge to be out of the Access Energy easement and be 20 feet vertical distance from the existing gas line. As Jackson Construction was ready to do the drilling to verify the drilled shaft depths on April 1, 2013, Access Energy's field representative had concerns on where the gas line was located. After talking tn Access representatives it was determined that the asbui|t plans for the 24" gas line that Access Energy provided were not accurate. Using the most accurate locating device Access Energy hod, it was estimated the gas line was 20-25 feet shallower than initially thought, putting it in conflict with the proposed bridge drilled shafts. In an effort to find the best solution, Freese and Nichols has proposed a bridge design that would increase the distance from the Access Energy gas line horizontally by shifting the bridge to the vveat' Access Energy has approved this design modification and has agreed to pay the City of Fort Worth a not- to-exceed amount up to $100,000 for the redesign and any necessary construction modifications to the bridge resulting from shifting the bridge location to avoid the gas line conflict. Freese and Nichols proposes the following contract modification for the redesign of the proposed bridge. Revised Project Scope Bridge Improvements The redesign of the bridge will be approximately 6096 effort of the original design of the bridge. The bridge span will ba reduced from a9[Y span toanDC/ span. Many of the sheets are already created, but the new design will require effort in the engineering of the abutments, beam design and layout, slab plan,vvingvvo|| design and grading plan. As part of the new bridge design, a shared approach slab bridge will be added to the project to provide fora connection of the two bridges. Additional engineering effort is needed for the shared approach slab between the existing bridge and the proposed bridge. The previous design had the proposed approach slab functioning completely independent of the existing approach slab. Page 2of2 Mrs. Dena Johnson, P.E. Floodplain Mapping Additional hydraulic analysis for the revised bridge design is needed to confirm that the bridge still meets project objectives. Roadway Improvements The new bridge design will require modifications to the proposed profile of the road and bridge grading plan. The redesign will require additional coordination effort between Fnaees and Nichols, City VfFort Worth, Access Energy and Jackson Construction and the revised design plans, quantities and construction change order. As part of separate matter, Freese and Nichols will coordinate with the Parks Department and Jackson Construction for access to the park in order tm build the bridge. Compensation Freese and Nichols request lump sum contract fee modification of $44,200.00.
