AGREEMENT FOR PUBLIC ART COMMUNITY WORKSHOP AND VISIONING
RECOMMENDATIONS FOR THE NOW1'H BEACH STREET CORRIDOR
BETWEEN THE CITY OF FORT WORTH AND VIA PARTNERSHIP, L.L.P.
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 42945
("First Amendment") is made and entered into by and between the City of Fort Worth, a home-
rule municipal corporation of the State of Texas, acting by and through its duty authorized
Assistant City Manager, and Via Partnership, L.L.P., a Missouri limited liability partnership,
located at P.O. Box 23167, St. Louis, Missouri 63156, and acting by and through Meridith
McKinley, its duty authorized Partner.
WHEREAS, on February 29, 2012, the City and Consultant made and entered into City
Secretary Contract No. 42945 (the "Agreement"), and the City designated the Arts Council of
Fort Worth and Tarrant County, Inc. as its Contract Manager;
WHEREAS, pursuant to the Agreement, Consultant conducted a community workshop
that explored the identity of the community along with public art and design enhancement
opportunities along the North Beach Corridor that reflect the environment, community, or other
themes appropriate to the Site;
WHEREAS, Consultant gained insight and understanding of the community and the
surrounding context while conducting the visioning workshops and study of the North Beach
Corridor, which uniquely qualifies Consultant as an arts professional with specific community
knowledge-,
WHEREAS, it is the desire of Consultant and City to increase Consultant's scope of
work to include serving as a voting member on the artist selection panel for the first North Beach
Corridor project implemented by City; and
WHEREAS, the City wishes to revise the payment schedule to compensate Consultant for
the additional scope of services.
NOW, THEREFORE, City and Consultant, in consideration of the mutual covenants
and agreements contained herein, do mutually covenant and agree that the Agreement is
amended as follows:
I.
The parties wish to amend Subsection 2.1 "Scope of Services," of Article 2 "North Beach Street Corridor
Public Art Community Workshop and Recommendations Scope of Services and Deliverables," to
increase the Consultant's scope of work by requiring the Consultant to serve as a voting member on
the artist selection panel for the first North Beach Corridor Project implemented by City.
Subsection 2.1 is amended to add the following Subsection:

Funds previously paid to the Consultant prior to this First Amendment shall apply toward
the total compensation paid to the Consultant.
IV.
All terms and conditions of the Agreement that are not expressly ainended pursuant to
this First Amendment shall remain in full force and effect.
V.
All terms in this First An-iendi-rent that are capitalized but iiot defined shall have the
meanings assigned to there in the Agreement.
