(No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Dannenbaum Engineering Corporation (Engineer) made and entered into City Secretary Contract No. 38950 (the Contract) which was authorized by the City Council by M&C C- 23658 on the 13th of August, 2009; as amended by Amendment #1 on the 12th of May, 2011 and WHEREAS, the Contract involves engineering services for the following project: 2008 Capital Improvements Program Arterial Street Project — Ray White Road Project No. 01294 WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly-authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 14, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $21,910.00. 2. TPW Department City of Fort Worth 1000 Throckmorton Street Fort Worth,Texas 76102-6311 RE: Supplemental Agreement No.2 Ray White Road Paving Improvements City Project Nos. 01294 Dear Ms. Smith: We have prepared and are submitting for your review the attachments to Supplemental Agreement No. 2 to design an enclosed box culvert storm sewer, update the construction plans, specifications, and estimates, and prepare an easement document. This plan revision will replace the open channel on the property at the southwest corner of the Ray White Road and Shiver Road intersection. This supplemental agreement also includes work to prepare, submit, and process a notification to the United States Army Corps of Engineers (COE) under the rules established by Nationwide Permit 14. We have included services from A.N.A. Consultants, L.L.C. to update the storm water pollution prevention plan and to prepare one easement document. In addition,we have included services from Berg-Oliver Associates, Inc., for the work necessary for submitting the notification to the COE as described above. The above referenced sub-contractors are certified MWBE. For this amendment,the percentage of the contract being performed by approved M/WBE firms will be 55%. This will result in a 26.6% portion of the overall project agreement that will be performed by approved M/WBE firms. If you are in agreement with the attachments for Supplemental Agreement No. 2, our authorized compensation will increase by $21,910.00. The $216,731.00 original contract amount along with the amount of $19,676.00 Supplemental Agreement No. 1, both previously authorized will be increased to $258,317.00. Compensation: A. The Engineer shall be compensated a total lump sum fee of$21,910.00 as summarized in Exhibit`13-313". Payment of the total lump sum fee shall be considered full compensation for the services described in Exhibit "A-1" and Exhibit"A-2" for all labor materials, supplies and equipment necessary to complete the project. B. The Engineer shall be paid monthly as described in Exhibit 1113-111, Section 1 —Method of Payment. Each Invoice is to be verified as to its accuracy and compliance with the terms of this contract by an officer of the Engineer. II. Schedule: A. Phases 1 and 2 shall be completed 180 days after the "Notice to Proceed" letter is issued. Method of Payment Partial payment shall be made to the Engineer monthly upon City's approval of an invoice from the Engineer outlining the estimated current percent complete of the total project. The aggregate of such monthly partial fee payments shall not exceed the following: Until satisfactory completion of Exhibits "A-1" and "A-2", Conceptual Engineering plan submittal and approval by the City, a sum not to exceed 30 percent of the total lump sum fee. Until satisfactory completion of Exhibits "A-1" and "A-2", Preliminary Construction Plan submittal to City, a sum not to exceed 60 percent of the total lump sum fee, less previous payments. Until satisfactory completion of Exhibits "A-1" and "A-2", Final Construction plan submittal and approval by the city, a sum not to exceed 90 percent of the total lump sum fee, less previous payments. Il. Progress Reports A. The Engineer shall submit to the designated representative of Director of Department of Engineering monthly progress reports covering all phases of design by the 15" of every month in the format required by the City. B.
