HomeMy WebLinkAboutContract 39645-A1 1 • AMENDMENT NO. 1 STATE OF TEXAS 8 CITY SECRETARY CONTRACT NO. - � 4115 -Al (M&C Needed) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Dunaway Associates, L.P. , (Engineer) made and entered into City Secretary Contract No. 39645, (the Contract) which was authorized by the City Council by M&C C-23975 on the 15th day of December 2009; and WHEREAS, the Contract involves engineering services for the following project: Avondale-Haslet Road, Project No. 01414 WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C C-24851,adopted by the City Council on the 12th day of April 2011 and further amplified in a proposal letter dated January 31, 2011, copies of which are attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $79, 781 . 00 . 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $771 ,241 . 00 . (CONSULTANT) is pleased to submit this Contract Amendment No.1 for additional professional civil engineering and land surveying services requested by the CITY for Avondale-Haslet Road between the eastern property line of the City's water tower and a point approximately 500 feet east of the BNSF railroad tracks. Additional Drainage Design Services 1. As a result of 30% conceptual drainage review comments, two (2) memoranda (Memo #1 dated 7/29/2010 & Memo #2 dated 12/28/2010) were prepared by CONSULTANT providing proposed solutions to the drainage issues identified. 2. Per recommendation made in Memo# 2, the following additional scope of services will be needed:- Hydrologic Analysis—CONSULTANT will perform a hydrologic analysis of the watershed contributing storm water to the existing railroad culvert immediately north of Avondale- Haslet Road, including: a) Verify the sub-watershed delineations for the areas that contribute storm water runoff to the existing 4'x3' railroad culvert north of Avondale-Haslet Road. b) Prepare hydrologic model of 'detention' at the existing railroad culvert and route the runoff hydrograph through the railroad culvert to verify the headwater elevation at the culvert and the depth of overtopping at Avondale-Haslet Road. C) Modify the hydrologic model to reflect diversion of the Avondale Farms subdivision runoff to the south side of Avondale-Haslet Road. Hydraulic Analysis— CONSULTANT will perform a hydraulic analysis of the existing 48-inch railroad culvert, including possible grading of the area immediately upstream of the railroad to accommodate potential development of the property south of Avondale-Haslet Road and west of BNSF RR: a) Determine the pipe capacity required to intercept runoff from the Avondale Farms subdivision and convey it to the southwest corner of the intersection of Avondale-Haslet Road and the BNSF railroad, where it will be released into an open channel along the west side of the railroad. b) Determine the capacity required for the open channel along the west side of the BNSF railroad. C) Utilize the preliminary site plan prepared by Teague Nall and Perkins dated 7/10/2009 for the area south of Avondale-Haslet Road (west of the BNSF railroad) to determine the maximum allowable detention pond area. d) Adjust the hydrologic model to reflect the detention areas on the preliminary site plan by revising the contour (storage) data upstream of the 48-inch railroad culvert and re-run the hydrologic model to verify adequate capacity (i.e., level of fill required for site grading). e) Attend two (2) coordination meetings with CITY and property owner to discuss the results of the hydrologic and hydraulics analyses, as well as the proposed storm drain pipe, open channel and detention pond layouts. f) CONSULTANT will revise the detention pond layout to accommodate the latest site plan for the property south of Avondale-Haslet Road. This task does not include detail design and associated construction plans for a detention pond. g) CONSULTANT will attend a second coordination meeting with CITY and property owner to discuss the results of the hydraulic analysis with the revised detention layout. 4. Design Drawings a) CONSULTANT will prepare conceptual (30%) design drawings showing the layout of the revised overall storm drain system including the 650 LF of additional proposed storm drain improvements resulting from the drainage diversion. Drawings will also show the existing storm drain system and other features (surface features and underground utilities) that impact the proposed drainage improvements. This scope does not include the design of special utility conflict structures or utility adjustments. b) CONSULTANT will prepare one (1) alternate storm drain alignment and an opinion of probable construction cost associated with the proposed improvements. This task will also include preliminary easement layouts for areas where the proposed storm drain improvements extend beyond the limits of current rights-of-way and/or easements. • Amendment No. 1 January 31, 2011 Page 3 c) CONSULTANT will attend one (1) review meeting with CITY to discuss CITY's review comments concerning the 30% storm drain design drawings. The date, time and location of the review meeting will be determined by CITY. d) CONSULTANT will address the items discussed at the 30% review meeting and incorporate changes agreed upon at the meeting into the storm drain improvements to be incorporated into the overall drawing set. These improvements include the additional storm drain plans, open channel ditch and additional cost estimates. The revised drawings will be incorporated into the 60%, 90% and 100% submittal sets, respectively, as outlined in the original contract scope of services. Additional Topographic Survey and Easement Services 5. After completion of the conceptual plan additional topographic survey and additional easements will be required at the following locations: Topographic Survey a. At the driveways on the Bulkmatic Transportation tract because of the containment berm needed. b. Along the south side of the proposed Avondale Haslet roadway because the initial survey was not wide enough to capture the proposed widening. c. Inside the BNSF RR ROW south of Avondale Haslet Rd as a result of the additional design of the open channel in the BNSF RR ROW. d. At the proposed detention site on the Hunter tract on the south side of Avondale Haslet Rd and 2000' north and south to the existing culverts for use in the detention pond analysis. e. At the Austin Stone/Avondale Haslet intersection for the design of the County turn lanes. This particular intersection was not selected for improvements in the original scope of services but was later requested to be added. Easements f. Four (4) slope easements will be needed along the adjacent properties of Avondale Haslet Rd (Hunter Cross Roads, Bulkmatic Transportation, Vista Cross Roads and Terry Wayne Barrow) as a result of the proposed roadway E elevation in relation to these properties. g. Up to three (3) drainage easements may be needed on Hunter Cross Roads, Bulkmatic Transportation and Vista Cross Roads properties as a result of the drainage diversion. h. Two (2) temporary right of entry documents will be needed on the Bulkmatic Transportation and Vista Cross Roads for re-grading of existing driveways. i • Amendment No. 1 January 31, 2011 Page 4 Additional Roadway Design Services 6. Per recommendation made memo #1 a containment berm will need to be designed on the north side of Avondale Haslet Rd to ensure that there are no major changes to the existing drainage pattern. 7. Per meeting on 12/2012010, City requested a paving jointing plan to be included in the construction plans. This task was not included in the original scope of services. No. 19653-04-2011 DATE: Tuesday, April 12, 2011 REFERENCE NO.: **C-24851 LOG NAME: 20AVONDALE HASLET DESIGN AMENDMENT DUNAWAY SUBJECT: Adopt Ordinance Finding that Conditions Have Materially Changed and Amending the Project Scope for Avondale Haslet Road Renovations and Authorize Amendment No. 1 in the Amount of$79,781.00 to City Secretary Contract No. 39645 with Dunaway Associates, L.P., for the Design of Avondale Haslet Road from US Highway 287 Frontage Road to Willow Creek Drive (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance finding that a material change has occurred such that the project scope and limits for Avondale Haslet Road from US Highway 287 Frontage Road to Willow Creek Drive of Proposition One of the 2008 Bond Program for Arterial Streets shall be amended and expanded; and 2. Authorize the City Manager to execute Amendment No. 1 in the amount of$79,781.00 to City Secretary Contract No. 39645 with Dunaway Associates, L.P., to provide additional engineering services and plan preparation for the widening of Avondale Haslet Road from US Highway 287 Frontage Road to Willow Creek Drive, thereby increasing the contract amount to $771,241.00. DISCUSSION: The 2008 Bond Program allocated $4,500,000.00 for the improvement of Avondale Haslet Road from 2,250 feet east of US Highway 287 Frontage Road to Burlington Northern Santa Fe (BNSF) Railroad to a four lane divided arterial road with sidewalks. It was originally anticipated that the improvements to the portion of the roadway from US Highway 287 Frontage Road to 700 feet east of the intersection of Haslet Court and Avondale Haslet Road would be built at a future date with funding through an agreement between Wal-Mart Stores Texas, LLC and the City of Fort Worth. However, an opportunity to build the section from US Highway 287 Frontage Road to a point 700 feet east of the intersection of Haslet Court and Avondale Haslet Road now has arisen. Wal-Mart Stores Texas, LLC, has agreed to contract for and manage the construction of a four lane roadway at this location if the City will provide funds sufficient to construct the northern two lanes of the roadway. Implementing the revised project pursuant to the agreement described above with Wal-Mart Stores Texas, LLC, would represent a material change to this project. Staff recommends that the scope of the Avondale Haslet Road project, as outlined in the 2008 Bond Program, be 1) amended to provide that for a segment of the roadway, only two lanes will be constructed rather than four lanes initially planned, and 2) expanded to include planning, design and construction for the limits, as follows: approximately 800 feet of a five lane section from the intersection at US Highway 287 Frontage Road going east; 2,900 feet of the northern two lanes of Avondale Haslet Road; 600 feet of four lanes of an arterial across the BNSF Railroad; and 500 feet of a transition back to the existing lanes at Willow Creek Drive. Lop-name: 20AVONDALE HASLET DESIGN AMENDMENT DIJNAWAY PaaP t nf� On December 15, 2009, (M&C C-23975), the City Council authorized the City Manager to execute an engineering agreement with Dunaway Associates, L.P., in the amount of$691,460.00 (City Contract No. 39645). Amendment No. 1 to the project design contract consists of providing additional survey, property exhibits, and hydraulic calculations that were not in the original scope of work. Dunaway Associates, L.P., has proposed to complete this additional design work for a lump sum fee of$79,781.00, thereby increasing the contract amount to $771,241.00. City staff considers this fee to be fair and reasonable for the scope of services to be performed. Funding for this project will come from the New Development Fund. Dunaway Associates, L.P., agrees to maintain its initial M/WBE commitment of 16 percent that it made on the original agreement and extend and maintain that same M/WBE commitment of 16 percent to this amendment. Therefore Dunaway Associates, L.P., remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 7, Mapsco, 4U, 4V, 5S and 5T.
