AMENDMENT NO. 1 TO
COMMUNITY FACILITIES AGREEMENT

COUNTY OF TARRANT § AUTHORIZING M&C NO. C-25130
WHEREAS, the City of Fort Worth (City) and NRP Contractors, LLC (Developer) entered
into a Community Facilities Agreement, City Secretary Contract No. 40594 ("CFA"); and
WHEREAS, it has become necessary to execute Amendment No. 1 to the CFA to add City
participation in an amount not to exceed $155,143.04 for the City's portion of costs associated with
the construction of 16-inch waterline contemplated by the CFA; and
WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the
13th day of September, 2011 via M&C C-25130.
NOW THEREFORE, City and Developer, acting herein by and through their duly authorized
representatives, enter into the following agreement, which amends the CFA:

The costs stated herein are based upon construction estimates. The City's portion of inspection
and material testing fees are directly allocated to the City's accounts for charges and does not
reimburse the Water Inspection and Material Testing Fees to the developer. The City's participation
estimate shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 (or by
public bid). The City's cost participation shall be in an amount not to exceed $155,143.04
("Participation"), but the reimbursement of the Participation (excluding inspection and material testing
fees) is not a lump sum amount and may be less than stated above depending upon actual quantities
from the Notice of Final Completion package ('Green sheet') and unit prices from the construction
contract document and Green sheet but not to exceed the unit prices contained in the City of Fort
Worth Ordinance No. 19192.

SUBJECT: Amend the Community Facilities Agreement City Contract No. 40594 with NRP

RECOMMENDATION:
It is recommended that the City Council authorize amending the Community Facilities Agreement with
NRP Contractors, LLC, for the City to participate in an amount not to exceed $155,143.04 for the
construction of the sixteen inch water main to serve Four Seasons at Clear Creek.
DISCUSSION:
NRP Contractors LLC, the developer of Four Seasons at Clear Creek has executed a proposed
contract for community facilities to serve a development located in south Fort Worth (see attached
map).
There will be City participation for the construction of 16 inch water main that will improve the service
to the Four Seasons at Clear Creek development and surrounding area.
The Developer is required to install a 10-inch water line. The Developer's estimated costs for water
and sewer improvements are subject to construction inspection and material testing fees.

The cost stated is based on the construction estimates. The City's participation reimbursement shall

19192 approved on June 22, 2010. The City's cost participation shall be in an amount not to exceed

actual quantities from the Notice of Final Completion package (Green sheet) and unit prices from the
construction contract document and Green sheet but not to exceed the unit prices contained in the

Upon Council's approval, City staff will execute an amended Community Facilities Agreement to
include City participation for water between the City and the Developer.
This project is located in COUNCIL DISTRICT 8.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Water Capital Projects Fund.
