IN ACCORDANCE WITH THIS CHANGE ORDER,THE CONTRACTOR SHALL: meet revised construction deadlines outlined in this change order,to include the
following modifications:
South Holly Access Road—waive the requirement and liquidated damages associated with returning the South Holly WTP access road to service within 14 days of outage
North Holly Ozone System—extend the in-service date of the ozone generation facility and ozone treatment process at North Holly from April 30 to June 15,2012
Staff has reviewed this change order and is in agreement with the Contractor's request for modifications to project milestones based on delays to the Contractor's critical path
construction operations from a 4"rain event that occurred in late January as well as proposed out of scope modifications to air scour piping in conflict with planned
improvements. This change order does not revise the contractual substantial completion date of June 25,2012,the final completion date of August 9,2012,or liquidated
damages associated with these events.
It is understood and agreed that the acceptance of this Change Order by the Contractor constitutes an accord and satisfaction and represents payment in full
(both in time and money)for all costs arising out of,or incidental to,the Change Order.

Re: REVISED, CMR-011 (request for time extension/sequence changes) for North And South Holly
WTP Upgrade—Ozonation Facilities
Dear Mr. Chris Harder,
The purpose of this writing is to make a formal request for time extensions/sequence changes on the above
referenced project. We are requesting the following:
• Extend the interim milestone portion of Phase 4 (commissioning of Ozone Generation Building &
commissioning of North Holly Ozone Contactor)to and in conjunction with interim milestone portion of
Phase 5 (commissioning of South Holly Contactors)
• No change to the completion milestones (substantial completion) June 25, 2012 and (final completion)
August 9, 2012. However. for clarification purposes, it should be mentioned that the Ozone System
performance testing is not required for substantial completion.
Our justification for the requested time extensions/ sequence changes can be attributed to the loss of 30 + days
due to above normal precipitation,particularly the January 25, 2012 and February 18, 2012 rain events that
flooded critical vault excavations causing extensive dewatering and demudding work. We also have performed
extra critical path work associated with (1) underground obstructions with North Holly conversion yard piping
(2)proposed relocation of meter vault and extra depth of valve vault and (3) proposed modifications with air
scour/chemical piping in the South Holly filter resulting in the accumulation of another 10 + days.
It should be mentioned that with exception to the requested changes above, all other designated milestones will
remain unchanged. Your consideration of this request is appreciated
