following changes, were made-
* Added the terms "Furnish/Install 13 or "Install" to clarify which items the City
will provide to the Contractor to install.
Added a Lump Sum pay item for Mobilization.

* Added a pay ife m for Exploratory Excavation of Existing utilities with
a quantity of 10 each.

3 THIS AGREEMENT,authorized on JanqaLy 14.,2014 is made by and between the City of Fort
4 worth, a Texas home rule municipality, acting by and through its duly authorized City Manager,

City and Contractor, in consideration of the mutual covenants hereinafter set fort, agree as

10 Contractor shall complete all Work as specified or indicated in the Contract Docu�x ents for the

15 New street light installations, or improvements to existing light standards to improve overall
traffic and pedestrian safety within-the City limits of Fort Worth.

19 Article 3. CONTRACT TIMIE

21 All time limits for Milestones, if any, and Final Acceptance as stated in the Contract
I 22 Documents are of the essence to this Contract.
23 3.2 Final Acceptance,

25 amount of$500,0001, not to exceed,has been exhausted.
26 3.3 Liquidated damages
27 Contractor recognizes that at tilne is of the essence of this Agreement and that City will
28 suffer financial loss if the Work is not completed within the tines specified in. Paragraph
29 31.2 above, plus any extension thereof alloyed in accordance with Article 1.2 of the
30 General Conditions. The Contractor also recognizes the delays, expense and difficulties
31 involved in proving in a. legal proceeding the actual loss suffered by the City if the Work
32 is not completed on time. Accordingly, instead of requiring any such proof, Contractor
33 agrees that as liquidated damages for delay (but not as a penalty), Contractor shall pay
34 City Six Hundred, and Fifty Dollars $650. for each day that expires after the time
IMP 35 specified In Paragraph 3.2 for Final Acceptance until the pity issues the Final Letter of
36 Acceptance.
