FIRST AMENDMENT To CITY SECRETARY ON ACT NUMBER 42301,
AN AGREEMENT BETWEENTHE CITE' of FORT WORTH AND

This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 42301 "First Amendment"" is
made and entered into by and between the City of Fort Worth, a home-rule municipal corporation of the State of'
Texas, "A e c
�' ")= acting by and through its du y authorized Assistant City Manager, and Monarch Utilities 1 L„P.,
Texas limited Partnership, by Texas Water Service Group, LL.C, a Texas limited liability company, its General
Partner "Monarch 11 .
WHEREAS, on September 6, 2011, the Agency and Monarch entered into an agreement for the
administration of a water utility assistance prograrri the carne being Port Worth City Secretary, Cointraot Number
4 301 "Agreement"),
WHEREAS, the initial term of the Agreement expired on December 31, 2012 and allowed for two, one
year renewal options;
WHEREAS, the Agency and Monarch renewed the Agreement for the first renewal period' of January 1,
2013 to December 31, 20131 on the same terms, and conditions, which the parties are memorializing as part of
this First Amendment
WHEREAS, the parties wish to continue in their relationship by exercising the second and final renewal
option, effective from January 1, 2014 through December 31, 2014; and
IOW, THEREFORE, for and in consideration of the mutual covenants contained herein, the Agency and
Monarch agree to amend the Agreement as follows:
Section 9 of the Agreement titled, "Tara and Termination," is hereby amended to read as follows:
"'The term of this Agreement shall he extended from Januarys 1, 2014 through December 31!,
20114. Either Agency or Monarch may terminate this Agreement, with or without cause, upon
thirty 3 days written notice to the other party."
All terms in this First Amendment that are capitalized but not defined shall have the rneanlin s assigned to,
them in the Agreement.
All terms and conditions of the Agreement that are not expressly amended pursuant to this First
Amendment shall remain in full force and effect.

It is, recommended' that the City Council:
1. Authorize acceptance of Water Utility Assistance Program funds from Monarch! Utilities I, L.P. in
an amount up to,$15,000.00 for the remainder of Fiscal Year 2011 and up to$501,000.00 in future
fiscal years;
2. Authorize execution of an Agreement with, Monarchy Utilities I, L.P., for administration of a Water
Utility Assistance Program by the Community fiction Partners in the Parks and Community Services
Department;nt and
Adopt the attached appropriation ordinanceI increasing estimated receipts and appropriations in
the Grants Fund by ups to $15,000.00 for Fiscal' Year 2011 1, subject to receipt of g rants.
DISCUSSION.
Monarch, utilities 1, LP (Monarch), provides water services in the, City of Blue Mound in Tarrant
County. The company has developed a water utility assist nce program to ,assist its low-income
customers who are experiencing financial distress to meet their grater utility costs.
The Community,Action Partners (CAP), in the Parks and Community Services apartment serves as
the designated community action agency for all of Tarrant County, in accordance with federal law.
CAP administers programs funded by Community Services Block Grants and the Comprehensive
Energy Assistance Program as well as utility ,assistance programs funded by utility companies.
'Under the proposed contract, CAP will process applications, determine income eligibility and
administer the funds. Bill assistance under the contract will be available to, Monarch customers only.
Monarch has informed CAP that funds of up to $15, 0. are available for the remainder of Fiscal
Year 2011 and that up to $50,01001.00 will be available in future fiscal years. This Agreement will begin
on execution and continua through! December 31, 2012 with two, one-year renewal options. Either
party may terminate the contract following thirty days notice.
