Home My WebLink AboutContract 43026 1k CITY SECRETARY CONTRACT No. PRETREATMENT SERVICES DIVISION CONTRACT FOR LIQUID WASTEHAULER PERMIT PRETREATMENT SERVICES WHEREAS, the City of Fort Worth and the City of Westworth Villa-ge entered into a contract for the treatment of wastewater, such contract bein g City of Fort Worth City Secretary Contract No. 15764, dated May 8, 1987; and WHEREAS, the City of Westworth Village is required by said contract to adopt and enforce an industrial pretreatment ordinance within its jurisdiction; and WHEREAS, the City of Westworth Villa a has requested that the City of Fort Worth perform inspections of liquid waste haulers operating within the jurisdiction of the City of Westworth Villa e, as well as permitting said liquid waste haulers to operate within the jurisdiction of the City of Westworth Villa e; and WHEREAS, the City of Fort Worth is agreeable to performing the permitting, inspection and manifest data management on behalf of the City of Westworth Village. NOW, THEREFORE, the City of Fort Worth, hereinafter referred to as "Fort Worth", and the City of Westworth Villa a hereinafter referred to as "Westworth Villa a", hereby agree as follows: 1. As of the date of this agreement, there are (approximatel five 5)) waste haulers working within the jurisdiction of Westworth Villa e, as listed in Exhibit A. This agreement and the charges contained herein are for the five 5 existing waste haulers. Except as otherwise provided herein, if additional waste haulers who want to work within the jurisdiction of Westworth Villa a this agreement will be either amended to include the additional waste haulers or Fort Worth's obligations hereunder shall be limited to the existing waste haulers. 2. Fort Worth agrees to perform the following basic services which are related to the liquid waste hauler permitting, section 9 of Fort Worth City Secretary Contract No. 15764 (the Contract), for Westworth Villa e: a. Review Liquid Waste Hauler permit applications submitted by liquid waste haulers operating within the jurisdiction of the City of Westworth Village b. Inspect and permit liquid waste haulers which have submitted permit applications containing valid information c. Prepare liquid waste hauler permits and issue them to approved liquid waste haulers ' OFFICIAL RECORD# CITY SECRETARY FT. WORTH, TX k d. Send permitted liquid waste haulers annual renewal application at least 30 days prior to expiration of liquid waste hauling permit e. Monitor liquid waste hauling activity and trip ticket data to ensure compliance with liquid waste hauling rules and regulations f. Maintain paper and electronic files for Westworth Village liquid waste haulers and update as necessary g. Advise Westworth Village monthly on enforcement actions for noncompliant liquid waste haulers, however, Fort Worth will conduct no enforcement actions within the jurisdiction of Westworth Village. 3. Westworth.Village agrees to pay Fort Worth for the basic services required hereunder as follows (see Exhibit B Fee Schedule): a. The sum collected for each liquid waste hauler permitted with payment payable to Westworth Village, submitted to pretreatment services described under Section 2. b. The sum collected for each trip ticket book with payment payable to Westworth Village submitted to pretreatment services described under Section 2. c. A monthly Contract Service charge. These charges shall be included in the monthly wastewater statement submitted to Westworth Village pursuant to the contract and shall be paid at the time such statement is due and payable. 4. Westworth Village agrees to pay Fort Worth for additional services as may be requested: a. None at this time b. None at this time These charges shall be included in the monthly wastewater statement submitted to Westworth Village pursuant to the Contract and shall be paid at the time such statement is due and payable. 5. This agreement shall terminate two years_after execution..,date, unless renewed as herein after specified. Westworth Village may renew this agreement on a bi-annual basis b giving _ Y g Y 9 g Fort Worth at least thirty (30) days prior written notice of its intent to renew. Within fifteen (15) days after receipt of such notice Fort Worth shall advise Westworth. Village of any escalation in charges. Within ten (10) business days, Westworth Villa a shall confirm in writing that it agrees to the escalation in charges. Failure to so notify Fort Worth shall render the agreement terminated at the end of the then current term. 6. The City of Fort Worth acknowledge receipt of Westworth Village Letter of Intent dated on January 22, 2014 [sic 2 13] and received by Pretreatment Services on JanUary 28, 2014, to renew aforementioned contracts for another two,years.
