FIRST AMENDMENT TO FORT WORTH CITY SECRETARY CONTRACT NO. 45819 This Amendment is made between the City of Fort Worth ("FORT WORTH"), a municipal corporation, acting herein by and through Fernando Costa, its duly authorized Assistant City Manager and John Grant ("the "Contractor"). WHEREAS, FORT WORTH and John Grant entered into an Agreement identified as Fort Worth City Secretary Contract No. 45819 ("Agreement") for professional services assisting the City's public art program; and WHEREAS, it is the collective desire of both FORT WORTH and Contractor to amend the Agreement to allow for additional services. NOW THEREFORE,KNOWN ALL BY THESE PRESENT: Fort Worth City Secretary Contract No. 45819 is hereby amended to be effective on August 13, 2014 by: 1. Replacing Article three (3) of the Agreement to read as follows: 3. COMPENSATION. The City shall pay Contractor an amount not to exceed eighteen thousand, one hundred, twelve dollars and no cents ($18,112.00) in accordance with the provisions of this Agreement, Exhibit B, and Exhibit C. If any conflict exists between Exhibit B and Exhibit C, the terms of Exhibit C shall control. Contractor shall not perform any additional services for the City not specified by this Agreement unless the City requests and approves in writing the additional costs for such services. The City shall not be liable for any additional expenses of Contractor not specified by this Agreement unless the City first approves such expenses in writing. 2. Replacing Exhibit "C" Compensation and Payment Schedule Section 1 (a)— (c) of the Agreement to read as follows: a. The City shall pay Contractor an amount not to exceed eighteen thousand, one hundred, twelve dollars and no cents ($18,112.00) for all services performed under this Agreement in accordance with the provisions of this Agreement, subject to the additional cost exceptions set forth in Sections 1.2 and 1.3 of this Agreement. Any additional cost exceptions set forth in Section 1.2 and 1.3 of this Agreement that cause the total Agreement amount to exceed eighteen thousand, one hundred, twelve dollars and no cents ($18,112.00) shall require an amendment to this Agreement. b. Contractor will bill City a rate of$100.00 per hour for only the actual hours worked and only up to fifty-five (55) hours. If Contractor exceeds fifty-five (55) hours, Contractor will only be paid for the additional hours if agreed to in writing by City.
